<br />Fulton Street Pedestrian Bicycle Corridor PAGE 55 OF 114 CONTRACT <br />FEDERAL AID # TAP-0420(026) <br />WO #3785 September 6, 2024 <br /> <br />All entities listed under 1 -07.18(2) of these Special Provisions shall be named as additional 1 <br />insureds on the Contractor’s Excess or Umbrella Liability insurance policy. 2 <br /> 3 <br />This requirement may be satisfied instead through the Contractor’s primary Commercial 4 <br />General and Automobile Liability coverages, or any combination thereof that achieves the 5 <br />overall required limits of insurance. 6 <br /> 7 <br /> 8 <br />1-07.18(5)E.rtf 9 <br />1-07.18(5)E LHWCA Insurance 10 <br />(January 4, 2016 APWA GSP) 11 <br /> 12 <br />If this Contract involves work on or adjacent to Navigable Waters of the United States, the 13 <br />Contractor shall procure and maintain insurance coverage in compliance with the statutory 14 <br />requirements of the U.S. Longshore and Harbor Workers' Compensation Act (LHWCA). 15 <br /> 16 <br />Such policy must provide the following minimum limits: 17 <br />$1,000,000 Bodily Injury by Accident – each accident 18 <br />$1,000,000 Bodily Injury by Disease – each employee 19 <br />$1,000,000 Bodily Injury by Disease – policy limits 20 <br /> 21 <br />COE 1-07.18(5)J.RTF 22 <br />1-07.18(5)J Pollution Liability 23 <br />(January 4, 2016 APWA GSP) 24 <br /> 25 <br />The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for 26 <br />claims involving bodily injury, property damage (including loss of use of tangible property 27 <br />that has not been physically injured), cleanup costs, remediation, disposal or other handling 28 <br />of pollutants, including costs and expenses incurred in the investigation, defense, or 29 <br />settlement of claims, arising out of any one or more of the following: 30 <br />1. Contractor’s operations related to this project. 31 <br />2. Remediation, abatement, repair, maintenance or other work with lead -based paint or 32 <br />materials containing asbestos. 33 <br />3. Transportation of hazardous materials away from any site related to this project. 34 <br /> 35 <br />All entities listed under 1-07.18(2) of these Special Provisions shall be named by 36 <br />endorsement as additional insureds on the Contractors Pollution Liability insurance policy. 37 <br /> 38 <br />Such Pollution Liability policy shall provide the following minimum limits: 39 <br />*** $2,000,000 *** each loss and annual aggregate 40 <br /> 41 <br /> 42 <br />1-07.23.GR1 43 <br />Public Convenience and Safety 44 <br /> 45 <br />1-07.23(1).GR1 46 <br />Construction Under Traffic 47 <br /> 48 <br />1-07.23(1).INST1.GR1 49 <br />Section 1-07.23(1) is supplemented with the following: 50 <br /> 51
