When one or more constituents fall outside the 4 <br />nonstatistical tolerance limits in the Job Mix Formula shown in Table of Price Adjustment 5 <br />Factors, the lot shall be evaluated in accordance with Section 1 -06.2 to determine the 6 <br />appropriate CPF. The nonstatistical tolerance limits will be used in the calculation of the 7 <br />CPF and the maximum CPF shall be 1.00. When less than three sublots exist, backup 8 <br />samples of the existing sublots or samples from the Roadway shall be tested to provide 9 <br />a minimum of three sets of results for evaluation. 10 <br /> 11 <br />5-04.3(9)C5 Vacant 12 <br /> 13 <br />5-04.3(9)C6 Mixture Nonstatistical Evaluation – Price Adjustments 14 <br />For each lot of HMA mix produced under Nonstatistical Evaluation when the calculated 15 <br />CPF is less than 1.00, a Nonconforming Mix Factor (NCMF) will be determined. The 16 <br />NCMF equals the algebraic difference of CPF minus 1.00 multiplied by 60 percent. The 17 <br />total job mix compliance price adjustment will be calculated as the product of the NCMF, 18 <br />the quantity of HMA in the lot in tons, and the unit Contract price per ton of mix. 19 <br /> 20 <br />If a constituent is not measured in accordance with these Specifications, its individual 21 <br />pay factor will be considered 1.00 in calculating the Composite Pay Factor (CPF). 22 <br /> 23 <br />5-04.3(9)C7 Mixture Nonstatistical Evaluation - Retests 24 <br />The Contractor may request a sublot be retested. To request a retest, the Contractor 25 <br />shall submit a written request within 7 calendar days after the specific test results have 26 <br />been received. A split of the original acceptance sample will be retested. The split of the 27 <br />sample will not be tested with the same tester that ran the original acceptance test. The 28 <br />sample will be tested for a complete gradation analysis, asphalt binder content, and, at 29 <br />the option of the agency, Va. The results of the retest will be used for the acceptance of 30 <br />the HMA in place of the original sublot sample test results. The cost of testing will be 31 <br />deducted from any monies due or that may come due the Contractor under the Contract 32 <br />at the rate of $500 per sample. 33 <br /> 34 <br />5-04.3(9)D Mixture Acceptance – Commercial Evaluation 35 <br />If sampled and tested, HMA produced under Commercial Evaluation and having all 36 <br />constituents falling within the tolerance limits of the job mix formula shall be accepted at 37 <br />the unit Contract price with no further evaluation.
