During initial review, it <br /> was determined that much of the proposed work will take place within this setback. Per EMC 19.38.030,alteration or <br /> expansion of a nonconforming structure (which does not meet required setbacks) is permitted so long as the <br /> nonconformity(1) is certified and (2) is not increased. <br /> Therefore, Planning requires the following to continue our review of this application: <br /> • Certificate of Nonconformity. Please submit a Land Use Application for a Nonconforming Structure. A PDF <br /> checklist with required application materials and submittal instructions is attached. <br /> Please note that the above comments do not constitute a through plan check review.
