AMENDMENT NO. 1 TO INTERLOCAL AGREEMENT <br />BETWEEN SNOHOMISH COUNTY AND CITY OF EVERETT <br />FOR KIWANIS PARK SPORT COURT REHABILITATION & <br />ENHANCEMENTS PROJECT <br /> <br />Page 1 of 1 <br /> <br />AMENDMENT NO. 1 TO INTERLOCAL AGREEMENT BETWEEN SNOHOMISH <br />COUNTY AND THE CITY OF EVERETT FOR THE KIWANIS PARK SPORT COURT <br />REHABILITATION & ENHANCEMENTS <br />THIS AMENDMENT NO. 1 (“Amendment No. 1”) to that certain Interlocal Agreement <br />between Snohomish County and the City of Everett, Washington concerning Kiwanis Park Sport <br />Court Rehabilitation and Enhancements project funding (the “Agreement”) dated December 28, <br />2023 is made by and between Snohomish County, a political subdivision of the State of <br />Washington (the “County”), and the City of Everett, a municipal corporation of the State of <br />Washington (the “City”). <br />The County Council has awarded $11,000 in additional funds through Ordinance 24-081 <br />to the City of Everett for the Kiwanis Park Sport Court Rehabilitation and Enhancements project. <br />NOW, THEREFORE, for and in consideration of the mutual benefits conferred on both <br />parties, the parties agree as follows: <br />1. Section G, RECITALS is hereby amended as follows: <br />Snohomish County has agreed to provide eighty-six thousand ($86,000) of REET II <br />funds (the “Funds”) to the project; and <br />2. Section 5.2, Payment is hereby amended as follows: <br />Unless the County delivers to the City written notice disputing the amount of a <br />particular line item, within twenty (20) working days of receipt from the City of an <br />invoice properly submitted to the County pursuant to Section 5.1, the County shall <br />remit to the City an amount not to exceed eighty-six thousand dollars ($86,000). In <br />the event the total costs of the Project is less than $86,000, the County shall only <br />remit those Funds necessary to pay the submitted invoice in full unless otherwise <br />disputed as provided in this Section 5.2. <br /> <br />EXCEPT AS PROVIDED IN THIS AMENDMENT NO. 1, ALL TERMS AND CONDITIONS <br />OF THE INTERLOCAL AGREEMENT DATED DECEMBER 28, 2023 SHALL REMAIN IN <br />FULL FORCE AND EFFECT. <br /> <br />SNOHOMISH COUNTY: CITY OF EVERETT: <br /> <br /> <br />______________________________ ______________________________ <br />Snohomish County Executive Title: Date <br /> <br />
