CITY OF EVERETT SPECIAL PROVISIONS <br /> <br /> <br /> <br /> <br /> Division 1 <br />Everett Mall Bus Platform General Requirements December 2024 <br />WO No – MALLSTN/24462 SP-57 <br />$1,000,000 combined single limit <br />1-07.18(5)C Workers’ Compensation <br />The Contractor shall comply with Workers’ Compensation coverage as required by <br />the Industrial Insurance laws of the state of Washington. <br />1-07.18(5)D Coverage for Working On, Over, or Near Navigable Waters <br />If this Contract involves Work on or adjacent to navigable water, as defined by the <br />U.S. Department of Labor, then the Contractor shall provide proof of insurance <br />coverage in compliance with the statutory requirements of the U.S. Longshore and <br />Harbor Workers' Compensation Act as administered by the U.S. Department of <br />Labor. <br />If the Contractor is working from barges or any other watercraft, owned or non- <br />owned, the Contractor shall maintain Protection and Indemnity (P&I) insurance <br />providing coverage for actions of the crew to third parties to the same limits stated <br />under 1 07.18(5)A of this section for Commercial General Liability Insurance. The <br />Contractor shall also provide proof of insurance coverage in compliance with the <br />statutory requirements of the Merchant Marine Act of 1920 (the "Jones Act"). <br />1-07.18(5)E Excess or Umbrella Liability <br />The limits stated in this section 1-07.18 may be satisfied by a combination of liability <br />and, if necessary, commercial umbrella/excess policies. <br />1-07.18(5)F Pollution Liability <br />The Contractor shall provide a Pollution Liability policy, providing coverage for claims <br />involving bodily injury, property damage (including loss of use of tangible property <br />that has not been physically injured), cleanup costs, remediation, disposal or other <br />handling of pollutants, including costs and expenses incurred in the investigation, <br />defense, or settlement of claims arising out of: <br />Contractor’s operations related to this project; <br />Remediation, abatement, repair, maintenance or other work with lead-based paint or <br />materials containing asbestos; and <br />Transportation of hazardous materials away from any site related to this project. <br />Such Pollution Liability policy shall provide the following minimum coverage: <br />$2,000,000 each loss and annual aggregate <br />1-07.18(5)G Professional Liability <br />The Contractor, its Subcontractor and its design consultant providing construction <br />management, value engineering, or other design-related non-construction <br />professional services shall provide evidence of Professional Liability insurance <br />covering professional errors and omissions. Such policy shall provide the following <br />minimum limits: <br />$2,000,000 per Claim <br />If the scope of such design-related professional services includes work related to <br />pollution conditions, the Professional Liability insurance shall include Pollution <br />Liability coverage. <br />If insurance is on a claims made form, its retroactive date, and that of all subsequent <br />renewals, shall be no later than the effective date of this Contract.
