CITY OF EVERETT SPECIAL PROVISIONS <br /> <br /> <br /> <br /> <br /> Division 1 <br />Everett Mall Bus Platform General Requirements December 2024 <br />WO No – MALLSTN/24462 SP-10 <br />The Proposal Form identifies the project and its location and describes the Work. It also <br />lists estimated quantities, units of measurement, the items of work, and the materials to <br />be furnished at the unit bid prices. Bidder shall complete spaces on the proposal form <br />that call for, and are not limited to, unit prices; extensions; summations; the total bid <br />amount; signatures; date; and, where applicable, retail sales taxes and acknowledgment <br />of addenda; bidder’s name, address, bidder’s email address, telephone number, and <br />signature; bidder’s UDBE/DBE/M/WBE commitment, if applicable; a State of Washington <br />Contractor’s Registration Number; and a Business License Number, if applicable. Bids <br />shall be completed by typing or shall be printed in ink by hand, preferably in black ink. <br />The required certifications are included as part of the Proposal Form. <br />Bidder shall submit Bidder’s Proposal on the Proposal Form provided in the Contract <br />Documents. <br />The City reserves the right to arrange the proposal forms with alternates and additives, if <br />such be to the advantage of the City. Bidder shall bid on all alternates and additives set <br />forth in the Proposal Form unless otherwise specified. <br />1-02.6 Preparation of Proposal <br />Delete “unless it approves in writing” from the second sentence of the first paragraph of 1- <br />02.6. <br />Revise the fourth paragraph of 1-02.6, beginning with “The Bidder shall submit with the Bid <br />a completed Disadvantaged Business Enterprise (DBE) Utilization Certification”, to read as <br />follows: <br />Contractor agrees that the Contractor shall actively solicit the employment of minority <br />group members. Contractor further agrees that the Contractor shall actively solicit Bids <br />for the subcontracting of goods or services from qualified minority businesses. <br />Contractor shall furnish evidence of the Contractor's compliance with these requirements <br />of minority employment and solicitation. Contractor further agrees to consider the grant <br />of subcontracts to said minority bidders on the basis of substantially equal proposals in <br />the light most favorable to said minority businesses. The Contractor shall be required to <br />submit evidence of compliance with this section as part of the Bid by submitting the <br />RCW 35.22.650 Certification. <br />Delete the sixth paragraph of 1-02.6, which begins with “The Bidder shall submit with their <br />Bid a completed Contractor Certification Wage Law Compliance form (WSDOT Form 272- <br />009).” <br />Supplement 1-02.6 by adding the following: <br />In the event that the product of a unit price and an estimated quantity does not equal the <br />extended amount quoted, the unit price shall govern, and the correct product of the unit <br />price and the estimated quantity shall be deemed to be the amount bid. If the sum of two <br />or more items in a bidding schedule does not equal the total amounts quoted, the <br />individual item amounts shall govern and the correct total shall be deemed to be the <br />amount bid. Do not qualify Proposal, since this will automatically be cause for rejection <br />of the Proposal. <br />Bidders are warned against making erasures or alterations of any kind to the Proposal <br />Form, and proposals that contain omissions, erasures, or irregularities of any kind may <br />be rejected. No oral, electronic, fax, telegraphic, or telephonic proposals or modifications <br />will be considered.
