CITY OF EVERETT SPECIAL PROVISIONS <br /> <br /> <br /> <br /> <br /> Division 1 <br />Everett Mall Bus Platform General Requirements December 2024 <br />WO No – MALLSTN/24462 SP-9 <br />1-02.4(1)A Interpretation of Contract Documents <br />(*****) <br />Should a Bidder find what is believed to be discrepancies in or omissions from the <br />Plans, Specifications, or Special Provisions, or should the Bidder be in doubt as to <br />their meaning, Bidder may submit to the Engineer a written request for an <br />interpretation thereof. The Bidder submitting the request will be responsible for its <br />prompt delivery. Any interpretation of the documents, if made, will be made only by <br />addendum duly issued and a copy of such addendum will be mailed or delivered to <br />each Bidder receiving a set of such documents. All requests for interpretations must <br />be received by the City or Engineer no later than 7 calendar days prior to the Bid <br />Opening Date. All questions regarding the Contract Documents shall be referred to <br />the City or Engineer at the address provided in the Contract Documents. <br />1-02.4(1)B Prevailing Wages <br />(*****) <br />Bidder is directed to 1-07.9(1) of these Special Provisions for requirements regarding <br />applying payment of prevailing wage rates for employment of labor on within <br />Snohomish County. <br />1-02.4(2) Subsurface Information <br />Delete the first paragraph and substitute the following: <br />If the City has made subsurface investigation of the site of the proposed Work, the <br />boring log data and soil sample test data accumulated by the City will be made <br />available for inspection by the Bidders. The boring logs and soil sample test data <br />shall NOT be considered as part of the Contract or the Contract Documents, <br />regardless of whether such data is supplied as an Appendix to the Special Provisions <br />or not. In addition, the City makes no representation or warranty expressed or <br />implied that: <br />1. The Bidders’ interpretations from the boring logs are correct, <br />2. Moisture conditions and indicated water tables will not vary from those found <br />at the time the borings were made, and <br />3. The ground at the location of the borings has not been physically disturbed or <br />altered after the boring was made. <br />The City specifically makes no representations, guarantees, or warranties as to the <br />condition, materials, or proportions of the materials between the specific borings <br />regardless of any subsurface information the Contracting Agency may make available to <br />the prospective Bidders. <br />Supplement 1-02.4(2) by adding the following: <br />The boring log data and soil sample data, if any, can be found in Appendix E. <br />If there is a geotechnical report made by the City, Bidder may contact City of Everett <br />Project Manager to arrange to view the geotechnical report. <br />The availability of subsurface information from the City shall not relieve the Bidder or the <br />Contractor from risks or of their duty to make examinations and investigations as <br />required by Section 1-02.4(1) or other responsibility under the Contract or as may be <br />required by law. <br />1-02.5 Proposal Form <br />Delete this section and substitute the following:
