CITY OF EVERETT SPECIAL PROVISIONS <br /> <br /> <br /> <br /> <br /> Division 1 <br />Everett Mall Bus Platform General Requirements December 2024 <br />WO No – MALLSTN/24462 SP-17 <br />be executed as if specified in both. In the event the Work to be done or matters <br />relative thereto are not sufficiently detailed or explained in the Contract Documents, <br />the Contractor shall immediately ask the City’s Representative for further explanation <br />and shall comply with such explanation. In the event of doubt or question arising <br />respecting the true meaning of the Specifications or Plans, Contractor shall refer to <br />the City’s Representative for its decision. <br />1-04.1(3)B Division of Specifications and Plans <br />Specifications and Plans are divided into groups for convenience. These divisions <br />are not for the purpose of apportioning Work or responsibility for Work among <br />Subcontractors, Suppliers and manufacturers. The Contractor is responsible for all <br />Work shown or described, regardless of location(s) in the Contract Documents. <br />1-04.1(3)C Discrepancies in Specifications and Plans <br />1-04.1(3)C(1) Errors and Omissions <br />If the Contractor becomes aware of any errors or omissions in the Contract <br />Documents or in the City's field work, it shall immediately inform the City’s <br />Representative in writing. The City’s Representative will promptly review the <br />matter and if it finds an error or omission has been made; it will determine the <br />corrective actions and advise the Contractor accordingly. If the corrective work <br />associated with an error or omission increases or decreases the amount of Work <br />called for in the Contract, the City will issue an appropriate Change Order. After <br />discovery by the Contractor of an error or omission, related Work performed by <br />the Contractor shall be done at its risk unless authorized by the City’s <br />Representative and approved by the City. <br />1-04.1(3)C(2) Conflicting Provisions <br />In the event an item of Work is described differently in two or more locations on <br />the Plans, in the Specifications and Special Provisions, the Contractor shall, <br />upon request of the City’s Representative, submit in writing to the City’s <br />Representative the description upon which the Contractor relied in preparing its <br />Bid or laying out the Work. <br />1-04.1(3)D Utilities <br />1-04.1(3)D(1) General <br />The City has endeavored to determine the existence of public and private utilities <br />at the site of the Work from the records of the owners of known utilities in the <br />vicinity of the Work. The positions of these utilities as derived from such records <br />are shown on the Plans. Unless otherwise noted, no excavations were made to <br />verify the locations shown for underground utilities. The service connections to <br />the gas, electric, cable TV and communication utilities are not shown on the <br />Plans. Refer to 1-07.17 UTILITIES AND SIMILAR FACILITIES regarding <br />Contractor’s responsibility for locating and verifying underground public and <br />private utilities. <br />1-04.1(3)D(2) Unknown/Incorrectly Marked Utilities <br />When a utility interferes with the Work and is either (1) not identified on the Plans <br />or (2) located in a position significantly different from that specified on the Plans <br />or in accordance with a particular utility’s standard depth and location, Contractor <br />shall follow the procedures of 1-04.7 DIFFERING SITE CONDITIONS <br />(CHANGED CONDITIONS).
