CITY OF EVERETT SPECIAL PROVISIONS <br /> <br /> <br /> <br /> <br /> Division 1 <br />Everett Mall Bus Platform General Requirements December 2024 <br />WO No – MALLSTN/24462 SP-18 <br />crosses or projects into the plane of the Work at an elevation between the top <br />and bottom of the Work. <br />1-04.2 Coordination of Contract Documents, Plans, Special Provisions <br />Specifications, and Addenda <br />Revise the first and second paragraphs of 1-04.2 to read as follows: <br />The complete Contract includes Division C – CONTRACT, Division P - PROPOSAL, <br />Division B – BID ITEM DESCRIPTIONS, Special Provisions, Contract Plans, Standard <br />Specifications, Standard Plans in effect as of the date Bids are opened, Addenda, <br />supplemental agreements, change orders, certifications and affidavits required by this <br />Contract and by law, and Federal requirements that apply to this Contract and Project. <br />These parts complement each other in describing a complete Work. Any requirement in <br />one part binds as if stated in all parts. The Contractor shall provide any Work or <br />materials clearly implied in the Contract even if the Contract does not mention it <br />specifically. <br />Any inconsistency in the parts of the Contract shall be resolved by following this order of <br />precedence: <br />1. Change Orders, <br />2. Addenda, <br />3. Division C – CONTRACT, <br />4. Division P - PROPOSAL, <br />5. Division B – BID ITEM DESCRIPTIONS <br />6. Special Provisions, <br />7. Contract Plans, <br />8. City’s Standard Drawings (if any) <br />9. WSDOT/APWA Standard Specifications for Road, Bridge, and Municipal <br />Construction, <br />10. WSDOT/APWA Standard Plans for Road, Bridge and Municipal Construction. <br />Revise the seventh paragraph of 1.04.2 to read as follows: <br />In case of any ambiguity or dispute over interpreting the Contract, the Engineer’s <br />decision will be final as provided in 1-05.1 AUTHORITY OF THE ENGINEER. <br />1-04.3 Reference Information <br />Revise 1-04.3 to read as follows: <br />Reference Information provided to the Contractor is not part of the Contract. The City of <br />Everett does not guarantee the accuracy of the Reference Information and is not <br />responsible for the content of the Reference Information in any manner. Any use of <br />Reference Information by the Contractor is done solely at the Contractor’s risk. <br />1-04.4 Changes <br />Delete 1-04.4 and substitute the following:
