<br /> <br />c. The Agency shall make every effort to engage participants in supportive services. <br />Supportive services shall emphasize participant choice and participation shall be <br />entirely voluntary. <br /> <br />G. The Agency shall not terminate Participants from the Project for any of the following <br />reasons: <br />a. Failure to participate in supportive services or treatment programs; <br />b. Failure to make progress on a housing stability plan; <br />c. Alcohol and/or substance use in and of itself is not considered a reason for <br />termination; <br />d. Households residing in emergency shelter must not be exited to homelessness due <br />to reaching a maximum stay limit; and, <br />e. The Agency must have a process in place for Participants terminated from a low <br />barrier project due to violating rules focused on maintaining a safe environment to be <br />considered for re-enrollment, if the household demonstrates unsafe behavior is <br />unlikely to re-occur. <br /> <br />H. The Agency shall ensure that Project units are of suitable dwelling size and meet <br />Habitability Standards; an inspection of the facility must be conducted and documented at <br />least once a year. <br /> <br />I. The Agency shall comply with the Lead-Based Paint Poisoning Prevention Act (42 U.S.C. <br />§§ 4821-4846), the Residential Lead-Based Paint Hazard Reduction Act of 1992 (42 U.S.C. <br />§§ 4851-4856), and implementing regulations at 24 CFR part 35, as applicable to the <br />activities under this Contract. <br /> <br />J. The Project will operate on a maximum ninety (90) day model. To the extent practicable, <br />residents will be assisted in obtaining housing within thirty (30) days of entry into the <br />emergency shelter. The shelter will strive to reduce the average length of stay. However, <br />residents may stay longer to prevent returns to homelessness. <br /> <br />K. If a household stays longer than ninety (90) days in emergency shelter, the Agency shall <br />document income eligibility (at or below thirty percent (30%) AMI). Income eligibility must be <br />documented at least every three (3) months thereafter. <br /> <br />L. Income limits are based on Area Median Income (AMI) which can be located at: <br />www.huduser.gov. Income is money that is paid to, or on behalf of, any household member. <br />Income includes the current gross income (annualized) of all adult (18 years and older) <br />household members and unearned income attributable to a minor. Income inclusions and <br />exclusions are listed in the Electronic Code of Federal Regulations, www.ecfr.gov, Title 24 – <br />Housing and Urban Development: Subtitle A 0-99: Part 5: Subpart F: Section 5.609 Annual <br />Income. <br /> <br />M. Gross Income is the amount of income earned before any deductions (such as taxes and <br />health insurance premiums) are made.
