Section 13.16.110 sets forth approval criteria for granting of a variance from the <br /> standards in Chapter 13.16 EMC.3 <br /> (1) The variance requested arises from peculiar physical conditions not ordinarily <br /> existing in similar districts in the city or is due to the nature of the business or <br /> operation upon the applicant's property. <br /> (2) That the variance requested is not against the public interest, particularly safety, <br /> convenience and general welfare; approved with the 2014 project. <br /> (3) That the granting of the permit for the variance will not adversely affect the rights of <br /> the adjacent property owners or tenants; <br /> (4) That the terms of this chapter will work unnecessary hardship on the applicant, <br /> property owner or tenant. <br /> Broadway Mixed Use Design Standards — EMC 19.31A.040 <br /> Vehicular Access <br /> • Driveways shall have a minimum separation of one hundred feet. <br /> • Maximum width of curb cuts is 25 feet. <br /> • Sidewalk pattern shall be carried across driveway. <br /> • Vehicular access is encouraged to be provided from side street or alley. <br /> Title 13 of the Everett Municipal Code has additional standards regarding driveway <br /> locations, for which a variance is requested. See section below related to the Title <br /> 13 variance. <br /> Alleys <br /> • Alleys shall be paved and maintained clear of obstructions. . <br /> • Pedestrian amenities including lighting, paving and rear entrances are encouraged. <br /> Parking <br /> • Parking is prohibited between buildings and streets. <br /> Pedestrian Connections <br /> Street Trees <br /> • Trees to be located between sidewalk and curb in vaults no less than 5' x 5'. <br /> • Trees shall take into consideration street lighting, adjacent tree species, signs and <br /> buildings. <br /> • Street trees shall be a minimum of 2.5 inch caliper at time of planting. <br /> • Street trees shall be irrigated. <br /> Roof Forms <br /> • Rooftop mechanical equipment shall be concealed by architectural screening. <br /> • Flat unembellished rooflines and bright roof colors are prohibited. <br /> • Residential buildings shall have pitched roofs with dormers or intersecting roof forms <br /> to break up the mass of a continuous sloping roof. An exception to this standard may <br /> 3 Section 13.16.110 explicitly authorizes City Council to grant variances. However, Council has since <br /> amended Title 15 of the Municipal Code granting said jurisdiction to the Hearing Examiner. See Section <br /> 15.16.110(A)(19) EMC. <br />
