In Section 5: Policies (2), <br /> (3) and (9): <br /> 2 Nonwater-oriented commercial uses should only be permitted when they provide public access <br /> ' and they provide ecological restoration,if appropriate and feasible, and they meet at least one ofthe <br /> following criteria: <br /> a. The site is physically separated from the shoreline by another property,public right-of-way, or <br /> significant environmentally sensitive area. <br /> ' The floodplain buffer restoration along the Snohomish River which is taking place in concurrence with this <br /> project is in a significant environmentally sensitive area. <br /> b. The use is part ofa mixed-use project or area that includes water-dependent uses. <br /> ' The proposed project is developed within the Port which inherently consist of water-dependent uses. <br /> c.Navigability is limited at the site. <br /> The waterfront area is limited to navigated shoreline use due to sediment deposition which is high due to the <br /> ' sites position on the river.The navigable use is 728 feet waterward from the shoreline.This area is not a good <br /> candidate for dredging. Where nonwater-oriented commercial uses are permitted, the development should provide views <br /> 1 of the shoreline from and through the site. <br /> Not Applicable <br /> (City of Everett Shoreline Management Program, 2011) <br /> ' 5.1.2 Regulations <br /> From Section 5 of the City of Everett's Shoreline Use Policies and Regulations: <br /> Il. The City of Everett shall require and use the following information in its review of commercial <br /> development proposals: <br /> a. Nature of the commercial activity(e.g., water-dependent, water-related, water-enjoyment, <br /> ' nonwater-oriented,mixed-use)including a breakdown of specific components; <br /> The proposed project is water-related due to the inherent nature with developing a project within the Port <br /> and the need for close proximity to water dependent business,but the project actions are not taking place in <br /> the water. <br /> ' b.Need for shoreline location; <br /> The proposed project has a need for a shoreline due to the inherent industry of the Port. <br /> c. Special considerations for enhancing the relationships ofthe activity to the shoreline; <br /> The proposed project is being developed in concurrence with the buffer restoration and public access <br /> pathway,as well as the proximity to Port operations. <br /> d. Provisions for public visual and physical access to the shoreline; <br /> The proposed project is being developed in concurrence with the buffer restoration and public access <br /> pathway. <br /> e.
