10.0 USE OF THIS REPORT <br />' This Biological Evaluation has been prepared for LBG 38, LLC, to comply with consultation <br />requirements under Section 7(c) of the Endangered Species Act. <br />' This Biological Evaluation addresses the effects of the proposed action as well as the interrelated <br />effects of the associated development on listed species. It addresses both direct and indirect <br />impacts of the project to listed species, their habitat and forage base. The determinations of effect <br />are based upon the effects analysis, which includes reviews of life history, habitat requirements, <br />literature review, agency consultation, and field reconnaissance studies conducted by WRI. <br />Effects on Essential Fish Habitat (EFH), as defined by NOAA's National Marine Fisheries <br />Service (NMFS, 1999), are also examined. <br />The laws applicable to fisheries biology/management are subject to varying interpretations and <br />' may be changed at any time by the courts or legislative bodies.
