of the proposed project from the abutting residential areas will be substantially obscured as is <br /> required. <br /> 3. Section 3.1.3 of the required Land Use mitigation measures (item 5) requires that"retaining <br /> walls greater than 4 feet in height and 40 feet in length that are visible from adjacent properties <br /> or public right of way shall be substantially screened with landscaping or architecturally <br /> designed and landscaped to break up the appearance of length/height in a manner approved by <br /> the Planning Director". It appears that there will be a substantial retaining wall along the north <br /> side of the development visible from the abutting properties to the north (up to about 20 feet in <br /> height according to Section 1,and up to 30 feet in Section 3 of drawings submitted to the <br /> Planning Department March 21, 2016). A design analysis is required to show how this mitigation <br /> requirement will be satisfied. <br /> Binding Site Plan <br /> EMC 18.28.020 includes the evaluation criteria for binding site plans reads, in part, as follows: <br /> 18.28.020 General evaluation criteria—Binding site plan and site plan approval. <br /> An application that complies with all of the following general evaluation criteria listed below,the <br /> requirements of this title, and applicable city standards shall be approved.An application that does <br /> not comply with these criteria shall be denied by the city. <br /> B. Zoning.The proposed binding site plan, site plan and other required application information <br /> shall meet the requirements of the Everett zoning code, except as permitted by the design and <br /> development provisions of this chapter; <br /> The binding site plan cannot be approved because it does not comply with development standards of <br /> the zoning code, or does not provide the information necessary to determine if it meets the standards of <br /> the zoning code, including the following: <br /> 1. The M-1 zone requires a minimum side yard setback of 15 feet. The proposed binding site plan <br /> includes a lot line between lots 3 and 4 that runs through the building,thereby creating a zero <br /> setback condition from the common property line. <br /> 2. There is no calculation of lot area for each lot indicated on the binding site plan map. The <br /> minimum lot area requirement for each lot in the M-1 zone is 5 acres. <br /> 3. There is no calculation of the required open space on each lot. The M-1 zone requires a <br /> minimum of 20 percent open space on each lot. <br /> 4. There is no calculation of lot coverage by building for each lot. The M-1 zone allows a maximum <br /> of 50%lot coverage by building. <br /> 5. There is no indication of the building height in relation to the distance the building is setback <br /> from the common property line with abutting residential zones.
