no self-insured retention with respect to the insurance requirements under this Section <br /> 18, unless approved in advance in writing by City in its sole discretion. <br /> c. If EGM fails to acquire or maintain any insurance or provide <br /> evidence of insurance required by this Section 18, City may, but shall not be required to, <br /> obtain such insurance or evidence and the costs associated with obtaining such insurance <br /> or evidence shall be payable by EGM to City on demand together with a fee for overhead <br /> and administrative expenses equal to 10% of such costs. <br /> Section 19. RISK OF LOSS TO PROPERTY. EGM bears all risk of any and all damage <br /> and loss to EGM property being on the Property. <br /> Section 20. MISCELLANEOUS <br /> a. No Warranty. The City does not warrant its title or ownership of the <br /> Property. <br /> b. Reservation of Rights. The City reserves all rights not expressly granted <br /> by this Lease. <br /> c. No Third Party Rights. This Lease does not create any rights in any third <br /> party. <br /> d. No Waiver. No waiver of any default hereunder shall be implied from <br /> any omission by either party to take any action on account of such default if such <br /> default persists or is repeated and no express waiver shall affect any default other than <br /> the default specified in the express waiver and then only for the time and to the extent <br /> therein stated. <br /> e.
