Also, how the Narrative responds to the criteria of City, State, and Federal <br /> Code is provided. <br /> In conclusion, if the owner of the property had applied for a business license for <br /> auto repair use —though possibly not necessary at time for the zone—before the <br /> adoption and enactment of the E-1 MOU zone this application would not be <br /> necessary. However that opportunity was not realized as there was no tenant just <br /> prior to the time of the rezone. The current tenant must meet the requirements <br /> to operate a business offering auto repair use. <br /> The City certified the Warehouse use as Non-conforming for the current zoning <br /> district. Current zoning for Evergreen Way— with an overlay addressing the Swift <br /> Transit corridor is E-1 MOU. The proposed auto repair service is listed in Chapter <br /> 19.05 USE TABLES/Table 5.2/ Nonresidential uses /vehicle related uses, but is <br /> excluded from E-1 MOU zone. Auto repair falls into the Maintenance, service <br /> (light) The EMC-1 defines it as a "business which services, maintains or repairs <br /> automobiles and small trucks, excluding vehicle body work and painting, and also <br /> excluding sale of motor fuel to the public". <br /> This application serves to demonstrate reason to grant a nonconforming use <br /> change. We believe we have demonstrated in the Narrative that the Criteria for a <br /> NCU change has been met. <br /> Through the Narrative we have shown— through its history and the buildings <br /> uses— to be compatible with the other business auto repair uses in close <br /> proximity. Those businesses front Evergreen Way, but not Mac's Auto.
