We believe those uses have been in compliance <br /> with the applicable State and Federal regulations. <br /> Mac's Auto, as originally built, was a storage warehouse. <br /> The City's permit files' history indicates a 1974 building and <br /> permitting from 1977. The City Assessor references this steel building <br /> as used for storage. Currently Chapter 19.05 USE TABLES/Table 5.2/ <br /> Nonresidential uses/vehicle related uses defines auto repair as <br /> Maintenance, service (light) .Auto repair is a use found in the IBC <br /> Group S-1 designation, an allowed use in the time of the building's <br /> construction in 1974 and remains an IBC allowed use. <br /> The recently adopted E-1 MOU is promoting transit oriented <br /> development emphasizing pedestrian and bicycle pathways. This <br /> appears to primarily impact new development proposed for <br /> Evergreen Way. This building had been used as a warehouse but was <br /> purchased to house, repair and maintain the Kegel Survey Company's <br /> fleet. This type of use is now considered to be "Maintenance, service <br /> (light)" which according to Chapter 19.04 ZONING CODE <br /> DEFINITIONS is a business which services, maintains or repairs <br /> automobiles and small trucks, excluding vehicle body work and <br /> painting, and also excluding sale of motor fuel to the public. This is <br /> not stated in the permit history but is substantiated by Western <br /> Engineers & Surveyors' owner Ken Long, who purchased the building <br /> from Kegel & Associates. From 2000 to 2010 the business Renu, <br /> another tenant, used the storage building for service and repair of <br /> their equipment— an industrial use. Since 2015 Bayside Auto leased <br /> the house and irregularly used the warehouse for servicing and auto <br /> repair. When Ken Long considered buying the parcel he saw the <br /> utility of the office and warehouse, which was similar to seller Kegel <br /> Surveying. It appeared to suit his company's need for the business <br /> operation and the possible housing of his fleet of survey trucks—as it <br /> did the original tenant.
