Property, the storm water detention vault, the wetland area, the park area, all open <br />space tracts, and access and utility tracts. <br />1.3 "Articles". The Articles of Incorporation of SIMPSON HOMEOWNERS <br />ASSOCIATION filed with the Secretary of State of the state of Washington. <br />1.4 "Association". SIMPSON. HOMEOWNERS ASSOCIATION, its successors <br />or assigns. <br />1.5 "Base Assessment". Assessments levied on all Lots subject to <br />assessment under Article 9 to fund Common Expenses for the general benefit of all <br />Lots, as more particularly described in Sections 9.1 and 9.2. <br />1.6 "Board of Directors" or "Board". The body responsible for administering <br />the Association, selected as provided in the Bylaws and serving as the Board of <br />Directors under Washington corporate law. <br />1.7 "Builder". Any person other than Declarant purchasing one or more Lots <br />to construct improvements thereon for resale to consumers or for further subdivision, <br />development and/or resale in the ordinary course of such person's business. <br />1.8 "Bylaws". The Bylaws of the Association, as they may be amended. <br />1.9 "Class "B" Control Period". The period during which any Class "B" <br />Member owns a Lot, or at such earlier time as the Class "B" Members, in their sole <br />discretion, may determine. <br />1.10 "Common Expenses". The actual and estimated expenses incurred, or <br />anticipated to be incurred, by the Association for the general benefit of all Owners, <br />including any reasonable reserve, all as may be found necessary and appropriate by <br />the Board under this Declaration, the Bylaws and the Articles of the Association. <br />Common Expenses include but are not limited to real estate taxes and similar charges <br />for Common Areas. <br />1.11 "Common Area". The Common Areas are all portions of the Property not <br />subdivided for individual Lots or not dedicated to the City as public streets, utility <br />systems or public areas or facilities. All Common Areas are owned and maintained by <br />the Association for the benefit of all Owners as described herein. The Common Areas <br />include, but are not limited to, (a) the private roads located within the Property; (b) <br />Access and Utility tracts; (c) storm water detention vault and related facilities; (d) open <br />space and a recreation area on the surface; (e) wetland buffer area; and (f) pedestrian <br />paths. Tract G contains a pedestrian access path.
