CITY OF EVERETT SPECIAL PROVISIONS <br />LS47-Beverly Lake Sewer Replacement Division 1 – GENERAL REQUIREMENTS January 30, 2025 <br />WO No – UP3529 SP – 71 <br />the City, to define the quality of an item of Work, specifies in the Contract a means, <br />method, technique, sequence or procedure for construction of that item of Work. The <br />Contractor shall execute Work in conformity with the standard practice of the trade. <br />1-05.18(3) Responsibilities <br />1-05.18(3)A Manufacturers and Suppliers <br />The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br />manufacturers, Suppliers and their employees. <br />1-05.18(3)B Contractor's Employees <br />The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br />its employees. Workers shall have sufficient knowledge, skill and experience to <br />perform properly the Work assigned to them. <br />1-05.18(3)C Payment for Labor and Materials <br />The Contractor shall pay and require its Subcontractors to pay any and all accounts <br />for labor including Worker's Compensation premiums, State Unemployment and <br />Federal Social Security payments and other wage and salary deductions required <br />by law. The Contractor also shall pay and cause its Subcontractors to pay any and <br />all accounts for services, equipment, and materials used by him and its <br />Subcontractors during the performance of Work under this Contract. The <br />Contractor shall pay such accounts as they become due and payable. If requested <br />by the City, the Contractor shall promptly furnish proof of payment of such accounts <br />to the City. <br />1-05.18(3)D Attention to Work <br />The Contractor, either in person or acting through its representative, shall give <br />personal attention to and shall manage the Work so that it shall be prosecuted <br />faithfully and completed under the Project schedule. When its representative is not <br />personally present at the Project site, its designated alternate shall be available and <br />shall have the authority to act in matters relating to this Contract. <br />Where detailed construction requirements are not set forth in the Standard <br />Specifications or these Special Provisions, the Contractor shall perform the Work of <br />a quality comparable to the workmanship specified for other parts of the Work, from <br />firms having established good reputations for similar Work, or by following industry <br />standard practices. The Contractor shall perform all Work in compliance with and <br />conforming to applicable building codes in effect at the time the Work is being <br />performed. <br />1-05.18(3)E Safety <br />The Contractor alone shall be responsible for safety on the job site, including, but <br />not limited to, the safety of its and its Subcontractor's employees. The Contractor <br />shall maintain the Project site and perform the Work in a manner that meets the <br />City's responsibility under statutory and common law for the provision of a safe <br />place to work. <br />1-05.18(3)F Threats, Intimidation and Harassment Forbidden <br />Contractor shall not allow its employees, its Subcontractors, its Subcontractors’ <br />employees, or any other agents to threaten bodily injury or property damage, to <br />intimidate or attempt to intimidate any person, or to assault or physically harass any <br />person. Forbidden conduct includes, but is not limited to, threatening, appearing, <br />or actually doing any of the following: pushing, shoving, striking, physically blocking <br />a person or a person’s vehicle, vandalism, malicious mischief, or any other act that <br />a reasonable person would understand be intended to intimidate, cause personal
