determine if revisions to the City's comprehensive plan or development regulations are in <br /> the public interest. The public interest is best served by working with the community, the <br /> property owners and other stakeholders to evaluate a range of reuse alternatives; <br /> 10. RCW 36.70A.390 allows a local government to establish an"interim official control"for <br /> purposes of conducting planning studies to determine appropriate land use policies and <br /> regulations for areas under its'jurisdiction; <br /> 11. An interim official control can be applied for up to one year if a work plan is developed <br /> for related studies; <br /> 12. The City proposes that the interim control be established for a period of one year,to <br /> preclude the establishment of vested rights that could be incompatible with the plans, <br /> policies, and regulations that the City may adopt as a result of the planning process; <br /> 13. The interim official control would be enacted to allow the City, in light of changed <br /> circumstances, to conduct planning studies to determine viable uses and to determine <br /> what is in the best long term interests of the community as it pertains to the subject <br /> property; <br /> 14. RCW 36.70A.390 and the Everett Charter,Article III, authorize the City Council to enact <br /> an interim regulation to preserve the integrity of the planning process. <br /> WHEREAS, the City Council concludes the following: <br /> 1. The City has the authority to adopt an interim official control; <br /> 2. It is in the best interests of the City of Everett to establish an interim official control <br /> governing the use of the Silver Lake Center properties in order to allow only a high <br /> quality mixed-use development while the City conducts appropriate planning analysis to <br /> consider the best long term interests of the Everett community as it pertains to the re-use <br /> and redevelopment of the subject properties; <br /> 3. The interim official control that governs the use and development of the subject <br /> properties allows for and promotes development of a high-quality mixed use <br /> development, consistent with the character of development that has been planned and <br /> previously approved by shoreline permit#03-010; <br /> 4. The interim official control herein established provides for immediate considerable <br /> development potential, allowing the current or future property owners substantial <br /> property development rights; <br /> 2 <br />
