5. An interim official control with respect to the Silver Lake Center property will allow the <br /> City to complete its planning process and authorize,but limit, any development during <br /> this interim period to development that is consistent with the current expectations of the <br /> City and the community as defined in this Ordinance. It will prevent the establishment of <br /> vested rights incompatible with this Ordinance and the plans,policies and regulations the <br /> City may adopt as a result of the planning process; <br /> 6. The interim official control herein established is necessary to provide for the public <br /> health, safety and welfare. <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact. The "WHEREAS"provisions above shall constitute Findings of <br /> Fact and are incorporated by reference as if fully set forth herein. <br /> Section 2. Interim Regulation. The following interim regulation is hereby established with <br /> respect to the Silver Lake Center properties as depicted on Exhibit A ("Property"), which is <br /> attached hereto and incorporated herein by reference: <br /> A. Subdivision prohibited. Subdivision, segregation, or sale of portions of the Property into <br /> individual lots or parcels during the effective period of the interim official control shall <br /> be prohibited, unless consistent with an integrated development plan required by this <br /> interim official control and approved by the City. <br /> B. Permitted Uses. Only retail, office, commercial and residential uses as provided by the <br /> B-2 zone are permitted on the Property consistent with the terms of the interim official <br /> land use controls established herein,provided however, that an automobile fueling or <br /> service station is not permitted. <br /> C. Development Standards—Mixed Use Required. The development of the Property <br /> shall be in the form of an integrated mix of residential and permitted non-residential uses <br /> as a high quality urban development that incorporates all required off-street parking, <br /> pedestrian walkways, and open space areas in a single, unified development. <br /> Commercial building space shall comprise a minimum of twenty-five percent of the gross <br /> floor area of the total building space, or as an alternative, publicly oriented space for a <br /> public use such as a library, or publicly accessible indoor or outdoor open space, may be <br /> used to satisfy this requirement. <br /> D. Development Standards—Green Lantern Park. The development of the Property <br /> shall include improvements to Green Lantern Park in lieu of providing required on-site <br /> open space and recreation facilities that would otherwise be required by the City's land <br /> use code. The scope and quality of improvement to Green Lantern Park shall be closely <br /> coordinated with the Parks and Recreation Department. The Parks and Recreation <br /> 3 <br />
