<br />27 (2) The funding appropriated under this section must be combined <br />28 with local funds <br /> <br />29 (3) The department may not expend funding for a project in this <br />30 section unless and until the nonstate share of that project's costs <br />31 have been either expended or firmly committed, or both, in an amount <br />32 sufficient to complete the project or a distinct phase of the <br />33 project. This requirement does not apply to projects where a share of <br />34 the appropriation is for design costs only. <br /> <br />The Youth athletic facility account is inappropriately paying for MLB, MiLB, and MLBPA design costs. <br /> <br />35 (4) Prior to receiving funding, grant recipients must demonstrate <br />36 that the project site is under control for a minimum of 10 years, <br />37 either through ownership or a long‐term lease. This requirement does <br /> <br />p. 59 ESSB 5200.PL <br /> <br /> <br />1 not apply to grants for preconstruction activities or grants in which <br />2 the sole purpose is to purchase real property that does not include a <br />3 construction or renovation component. <br /> <br />The Youth athletic facility account is inappropriately paying for MLB, MiLB, and MLBPA pre construction activities. <br /> <br />The "New Stadium" project site is currently clearly not under control for a minimum of 10 years, either through <br />ownership or a long term lease. <br /> <br />4 (5) In contracts for grants authorized under this section, the <br />5 department must include provisions that require that capital <br />6 improvements be held by the grantee for a specified period of time <br />7 appropriate to the amount of the grant and that facilities be used <br />8 for the express purpose of the grant. If the department finds the <br />9 grantee to be out of compliance with provisions of the contract, the <br />10 grantee shall repay to the state general fund the principal amount of <br />11 the grant plus interest calculated at the rate of interest on state <br />12 of Washington general obligation bonds issued most closely to the <br />13 date of authorization of the grant. <br /> <br />The Youth athletic facility account is inappropriately paying for MLB, MiLB, and MLBPA design costs, pre construction <br />activities, and costs that are not for the express purpose of the Everett School District: Everett Memorial Stadium grant. <br /> <br />The $7.4 million grant for the Everett School District: Everett Memorial Stadium should be returned to the Youth athletic <br />facility account. <br /> <br />RCW 43.99N.060 reads: <br /> <br />"(3)(c) The balance, if any, shall be transferred to the youth athletic facility account under subsection (4) of this section. <br /> <br />(4) Any moneys in the stadium and exhibition center account not required or permitted to be used for the purposes <br />described in subsection (3)(a) and (b) of this section shall be deposited in the youth athletic facility account hereby
