The Owner makes no representation <br />as to the currency, accuracy, or completeness of the list. <br />3.4 LABOR AND MATERIALS <br />k 3.4.1 Unless otherwise provided in the Contract Documents, the Contractor shall provide and pay for <br />a sufficient labor force and shall provide and pay for materials, equipment, tools, construction equipment <br />and machinery, water, heat, communications, utilities, transportation, hauling arrangements and other <br />facilities and services necessary for proper and timely execution and completion of the Work, whether <br />- temporary or permanent and whether or not incorporated or to be incorporated in the Work. <br />3.4.2 After the Contract has been executed, the Owner and the Architect may consider a formal request <br />from the Contractor for the substitution of products in place of those specified only under exceptional <br />conditions. Whether or not to grant such request shall be entirely subject to the Owner's discretion upon <br />recommendation(s) from the Architect. By making requests for substitutions, the Contractor: <br />r p <br />.1 represents that the Contractor has personally investigated the proposed substitute product and <br />determined that it is equal or superior in all respects to that specified; <br />.2 represents that the Contractor will provide the same or greater warranty for the substitution that <br />the Contractor would provide for that specified; <br />mcg-ARC 2120.000 February 28, 2023 <br />
