If <br />applicable, the results of such investigations are available at the Architect's office for the convenience <br />of the prospective bidders and the Contractor, but are not to be considered a part of the Contract <br />Documents. The Contractor accepts full responsibility for interpreting such results and/or making any <br />assumptions that differ from information stated expressly in such results. The Contractor shall be solely <br />responsible for any interpretations of the information or extrapolations beyond the location of any <br />individual boring or test pit result made available by Owner. <br />There is no guarantee, either express or implied, that the conditions indicated are representative of those <br />existing throughout the site, or that unforeseen developments may not occur. If conditions are <br />encountered which are (1) subsurface or otherwise concealed physical conditions which differ materially <br />from those indicated in the Contract Documents or (2) unknown physical conditions that were not <br />foreseeable because they differ materially from those ordinarily found to exist and generally recognized <br />as inherent in construction activities of the character provided for in the Contract Documents, then the <br />Contractor shall give written notice to the Owner and the Architect promptly before conditions are <br />disturbed but no later than three (3) days after first observance of such conditions. If feasible, within ten <br />(10) days after such notice, the Contactor shall submit any proposed changes to the Contract Sum and/or <br />Contract Time. <br />3.3 SUPERVISION AND CONSTRUCTION PROCEDURES <br />3.3.1 The Contractor shall supervise and direct the Work, using the Contractor's best skill and <br />attention. The Contractor shall be solely responsible for and have control over safety of the Work Site, <br />for construction means, methods, techniques, sequences and procedures, for determining and providing <br />the appropriate manpower, and for protecting and coordinating all portions of the Work under the <br />Contractor, unless the Contract Documents give other specific instructions concerning these matters. <br />3.3.2 The Contractor shall be responsible to the Owner for acts and omissions of the Contractor's <br />employees, Subcontractors and their agents and employees, and other persons performing portions of <br />the Work under a contract with the Contractor. <br />3.3.3 The Contractor shall not be relieved of obligations to perform the Work in accordance with the <br />Contract Documents either by activities or duties of the Architect in the Architect's administration of the <br />Contract, or by tests, inspections or approvals required or performed by persons other than the <br />Contractor. <br />3.3.4 The Contractor shall be responsible for inspection of portions of Work already performed under <br />this Contract to determine that such portions are in proper condition to receive subsequent Work. <br />3.3.5 In performing the Work, the Contractor shall comply with all applicable federal, state and local <br />laws and regulations including, but not limited to, the following: <br />(1) Chap. 18.27 RCW relating to Contractor's registration; <br />(2) Chap. 19.27 RCW relating to the State building code; <br />(3) Chap. 27.44 RCW relating to Indian graves; <br />mcg-ARC 2120.000 February 28, 2023 <br />
