SNO-ISLE TECH 2O23 SMALL WORKS <br />McGRANAHAN ARCHITECTS <br />Section 00 70 00, Page 51 <br />GENERAL CONDITIONS <br />9.9.2 Immediately prior to such partial occupancy or use, the Owner, Contractor and Architect shall <br />jointly inspect the area to be occupied or portion of the Work to be used in order to determine and record <br />the condition of the Work. <br />9.9.3 Use by Owner of any finished part of the Work, which has specifically been identified in the <br />Contract Documents, or which Owner, Architect and Contractor agree constitutes a separately <br />functioning process, facility or portion of the Work that can be used by Owner without significant <br />interference with Contractor's performance of the remainder of the Work, may be accomplished prior to <br />Substantial Completion of all the Work subject to the following: <br />Owner at any time may request Contractor in writing to permit Owner to use any such part of the Work <br />which Owner believes to be ready for its intended use and substantially complete. If Contractor agrees, <br />Contractor will certify to Owner and Architect that said part of the Work is substantially complete and <br />request Architect to issue a Certificate of Substantial Completion for that part of the Work. Contractor <br />at any time may notify Owner and Architect in writing that Contractor considers any such part of the <br />Work ready for its intended use and substantially complete and request Architect to issue a Certificate <br />of Substantial Completion for that part of the Work. Within a reasonable time after either such request, <br />Owner, Contractor and Architect shall make an inspection of that part of the Work to determine its status <br />of completion. If Architect does not consider that part of the Work to be substantially complete, <br />Architect will notify Owner and Contractor in writing giving the reasons therefor. If Architect considers <br />that part of the Work to be substantially complete, the provisions of subparagraphs 9.8.1 and 9.8.2 will <br />apply with respect to certification of Substantial Completion of that part of the Work and the division of <br />responsibility in respect thereof and access thereto. <br />9.9.4 Unless otherwise agreed, Owner's partial occupancy or use of a portion or portions of the Work <br />shall not constitute acceptance of Work not complying with the requirements of the Contract Documents. <br />9.10 FINAL COMPLETION AND FINAL PAYMENT <br />9.10.1 Upon receipt of written notice that the Work is ready for final inspection and acceptance and <br />upon receipt of a final Application for Payment, the Architect and Owner will promptly make such tests <br />and inspection and, when the Architect and Owner find the Work acceptable under the Contract <br />Documents and the Contract fully performed, the Architect will promptly issue a final Certificate for <br />Payment stating that to the best of the Architect's knowledge, information and belief, and on the basis <br />of the Architect's observations and inspections, the Work has been completed in accordance with terms <br />and conditions of the Contract Documents and that the balance found to be due the Contractor and noted <br />in said final Certificate is due and payable. The Architect's final Certificate for Payment will constitute <br />a further representation that conditions listed in Subparagraph 9.10.2 as precedent to the Contractor's <br />being entitled to final payment have been fulfilled. <br />9.10.2 Final Acceptance will not be granted until Owner has received and accepted Record Documents, <br />Operations and Maintenance Manuals, staff training on all operable equipment, final certificates of <br />occupancy from local jurisdictions and all required certificates or other evidence of warranties. Final <br />Completion must be achieved within thirty (30) days of the scheduled Substantial Completion date as <br />described in Paragraph 9.8. <br />mcg-ARC 2120.000 February 28, 2023 <br />
