SNO-ISLE TECH 2O23 SMALL WORKS Section 00 70 00, Page 52 <br />McGRANAHAN ARCHITECTS GENERAL CONDITIONS <br />9.10.3 Neither final payment nor any remaining retained percentage shall become due until the <br />Contractor submits to the Architect (1) an affidavit that payrolls, bills for materials and equipment, and <br />other indebtedness connected with the Work for which the Owner or the Owner's property might be <br />responsible or encumbered (less amounts withheld by Owner) have been paid or otherwise satisfied, <br />(2) a certificate evidencing that insurance required by the Contract Documents to remain in force after <br />final payment is currently in effect and will not be canceled or allowed to expire until at least thirty (30) <br />days' prior written notice has been given to the Owner, (3) a written statement that the Contractor knows <br />of no reason that the insurance will not be renewable to cover the period required by the Contract <br />Documents, (4) consent of surety to final payment, (5) other data establishing payment or satisfaction of <br />obligations, such as receipts, releases and waivers of liens, claims, security interests or encumbrances <br />arising out of the Contract, to the extent and in such form as may be designated by the Owner or as may <br />be required by applicable laws and regulations, and (6) all claims by the Contractor have been waived <br />or resolved. Such forms and filings shall include: <br />.1 Certificates approved by the Washington State Department of Labor and Industries, Washington <br />State Employment Security Department, and all other departments and agencies having jurisdiction over <br />the activities of the Contractor have been provided to the Owner; <br />.2 A release obtained from the Washington State Department of Revenue that state taxes have been <br />paid; and <br />.3 "Affidavits of Wages Paid" for the Contractor and each Subcontractor approved by the Industrial <br />Statistician of the Washington State Department of Labor and Industries have been provided to the <br />Owner. <br />If such taxes have not been discharged or the claims, expenses, and fees have not been paid, the Owner <br />shall either retain in its funds, or in an interest bearing account, or retain in escrow, at the option of the <br />Contractor, an amount equal to such unpaid taxes and unpaid claims together with a sum sufficient to <br />defray the costs and attorney fees incurred in foreclosing the lien of such claims, and shall pay, or release <br />from escrow, the remainder to the Contractor. <br />9.10.4 If a Subcontractor refuses to furnish a release or waiver required by the Owner, the Contractor <br />may furnish a bond satisfactory to the Owner to indemnify the Owner against such lien. If such lien <br />remains unsatisfied after payments are made, the Contractor shall refund to the Owner all money that <br />the Owner may be compelled to pay in discharging such lien, including all costs and attorneys' fees. <br />Lien notices shall be delivered to: <br />Mukilteo School District No. 6 <br />c/o Karen Mooseker <br />Executive Director, District Support Services <br />8925 Airport Road <br />Everett, WA 98204 <br />9.10.5 The making of final payment shall not constitute a waiver of any claims by the Owner, including, <br />but not limited to, those arising from: <br />mcg-ARC 2120.000 February 28, 2023 <br />
