2025 FEDERAL OVERLAY, W MUKILTEO BLVD – GLENWOOD AVE TO DOGWOOD DR <br /> PAGE SP21 OF SP123 SPECIAL PROVISIONS <br />WORK ORDER #3842 April 15, 2025 FEDERAL AID# NHPP-2776(011) <br />If a Construction Material is not manufactured in the United States it shall be 1 <br />considered a Foreign Construction Material. 2 <br /> 3 <br />2. Excluded Material: A material where Buy America requirements do not apply. This 4 <br />includes the following: 5 <br /> 6 <br />a. Materials excluded by Section 70917(c) of the Buy America, Build America Act 7 <br />with respect to aggregates this includes cement and cementitious materials, 8 <br />aggregates such as stone, sand, or gravel or aggregate binding agents or 9 <br />additives. These materials shall be classified as excluded materials based on 10 <br />the composition when brought to the work site. It also includes combinations of 11 <br />these excluded materials when mixtures of Excluded Materials are delivered to 12 <br />the work site without final form for incorporation into the project (i.e. wet concrete 13 <br />and HMA). If they are formed prior to delivery, they are a Manufactured Product 14 <br />and not an Excluded Material. 15 <br /> 16 <br />b. Temporary materials that are not being permanently incorporated into the 17 <br />project. 18 <br /> 19 <br />c. Raw or minimal processed materials where the article, material, or supply does 20 <br />not fall into any of the categories, as it is not a Manufactured Product, an Iron or 21 <br />Steel Product, or a Construction Material and when these materials are 22 <br />delivered to the work site without final form for incorporation into the product (i.e. 23 <br />seed mix and topsoil). If they are formed prior to delivery, they are a 24 <br />Manufactured Product and not an Excluded Material. 25 <br /> 26 <br />3. Iron or Steel Product: An article, material, or supply that consist of wholly or 27 <br />predominantly of iron or steel or a combination of both. To be considered 28 <br />predominantly of iron or steel or a combination of both means that the cost of the iron 29 <br />and steel content exceeds 50 percent of the total cost of all its components. The 30 <br />cost of iron and steel is based on a good faith estimate of the cost of the iron or steel 31 <br />components. 32 <br /> 33 <br />4. Manufactured Product: A Manufactured Product includes any item produced as a 34 <br />result of the manufacturing process. Items that should be treated as a manufactured 35 <br />product (rather than a construction material) are: 1) items that consist of two or more 36 <br />of the listed construction materials that have been combined together through a 37 <br />manufacturing process, and 2) items that include at least one of the listed 38 <br />construction materials as defined above, combined with a material that is not listed 39 <br />through a manufacturing process. 40 <br /> 41 <br /> If a product is not an Iron or Steel Product, a Construction Material, or an Excluded 42 <br />Material, it is a Manufactured Product. 43 <br /> 44 <br />5. United States: To further define the coverage, a domestic product is a manufactured 45 <br />steel construction material that was produced in one of the 50 states, the District of 46 <br />Columbia, Puerto Rico, or in the territories and possessions of the United States. 47 <br /> 48 <br />Iron or Steel Product Requirements 49 <br />Iron or Steel Products that are permanently incorporated into the project shall consist of 50 <br />American-made materials only. Buy America requirements do not apply to temporary steel 51
