2025 FEDERAL OVERLAY, W MUKILTEO BLVD – GLENWOOD AVE TO DOGWOOD DR <br /> PAGE SP29 OF SP123 SPECIAL PROVISIONS <br />WORK ORDER #3842 April 15, 2025 FEDERAL AID# NHPP-2776(011) <br />firm. These Commitments will be incorporated into the Contract and shall be 1 <br />considered Contract requirements. 2 <br /> 3 <br />DBE Condition of Award (COA) Goal – An assigned numerical amount specified 4 <br />as a percentage of the Contract. At Bid, this is the minimum amount that the Bidder 5 <br />must commit to by submission of the DBE Utilization Certification form and, if 6 <br />necessary, by GFE Documentation. 7 <br /> 8 <br />Disadvantaged Business Enterprise (DBE) – A business that is owned and 9 <br />operated independently from other businesses and is certified by the Washington 10 <br />State Office of Minority and Women’s Business Enterprises, as meeting the criteria 11 <br />outlined in 49 CFR 26 regarding DBE certification. 12 <br /> 13 <br />Force Account Work – Work measured and paid in accordance with Section 1-09.6. 14 <br /> 15 <br />Good Faith Efforts (GFE)– Efforts to achieve the DBE COA Goal or other 16 <br />requirements of this Provision which, by their scope, intensity, and appropriateness 17 <br />to the objective, can reasonably be expected to fulfill the program requirement. 18 <br /> 19 <br />Good Faith Efforts (GFE) Documentation - The documentation of the Good Faith 20 <br />Effort. GFE Documentation is only required in the event that the Contractor is unable 21 <br />to fulfill the program requirements and shall follow the guidance of 49 CFR Part 26 22 <br />Appendix A. 23 <br /> 24 <br />Subcontractor, DBE – An individual, partnership, firm, corporation, or joint venture 25 <br />who meet the definition of a DBE and who is sublet part of the Contract. 26 <br /> 27 <br />Supplier, DBE – A Manufacturer, Regular Dealer, Distributor, or Transaction 28 <br />Facilitator who provides supplies or materials for the Contract. The role a Supplier 29 <br />performs is determined on a contract-by contact basis. 30 <br /> 31 <br />Manufacturer, DBE – A DBE firm that operates or maintains a factory or 32 <br />establishment that produces on the premises the materials, supplies, articles, or 33 <br />equipment required under the Contract. A DBE Manufacturer shall produce 34 <br />finished goods or products from raw or unfinished material or purchase and 35 <br />substantially alters goods and materials to make them suitable for construction 36 <br />use before reselling them. 37 <br /> 38 <br />Regular Dealer, DBE – A DBE firm that owns, operates, or maintains a store, 39 <br />warehouse, or other establishment in which the materials or supplies required 40 <br />for the performance of a Contract are bought, kept in stock, and regularly sold 41 <br />to the public in the usual course of business. To be a Regular Dealer, the DBE 42 <br />firm must be an established regular business that engages in as its principal 43 <br />business and in its own name the purchase and sale of the products in question. 44 <br />A Regular Dealer in such items as steel, cement, gravel, stone, and petroleum 45 <br />products need not own, operate or maintain a place of business if it both owns 46 <br />and operates distribution equipment for the products. Any supplementing of 47 <br />regular dealers’ own distribution equipment shall be by long-term formal lease 48 <br />agreements and not on an ad-hoc basis. Brokers, packagers, manufacturers’ 49 <br />representatives, or other persons who arrange or expedite transactions shall not 50 <br />be regarded as Regular Dealers within the meaning of this definition. 51 <br /> 52
