Failure to comply with the requirements of this Specification may result in your 18 <br />Bid being found to be irregular in accordance with Section 1-02.13 resulting in rejection 19 <br />or other sanctions as provided by the Contract. 20 <br /> 21 <br />DBE Abbreviations and Definitions 22 <br />Certified Business Description – The approved business description that 23 <br />supplements the North American Industry Classification System (NAICS) code listed 24 <br />in OMWBE’s directory of certified firms. 25 <br /> 26 <br />Certified Business Directory – A database of all Minority, Women, and 27 <br />Disadvantaged Business Enterprises currently certified by Washington State. The 28 <br />on-line Directory is available to Bidders for their use in identifying and soliciting 29 <br />interest from DBE firms. The database is located under the Firm Certification section 30 <br />of the Diversity Management and Compliance System web page at: 31 <br />https://omwbe.diversitycompliance.com. 32 <br /> 33 <br />Commercially Useful Function (CUF) – 34 <br />A firm performs a commercially useful function when it is responsible for execution 35 <br />of the work of the contract and is carrying out its responsibilities by performing, 36 <br />managing, and supervising the work involved as defined in 49 CFR 26.55(c)(1). To 37 <br />perform a commercially useful function, the firm must also be responsible, with 38 <br />respect to materials and supplies used on the contract, for ordering, negotiating price, 39 <br />paying for, determining quality and quantity, and installing (where applicable) for the 40 <br />material itself. 41 <br /> 42 <br />The DBE firm does not perform a CUF if its role is limited to that of an extra participant 43 <br />in a transaction, contract, or Project through which the funds are passed to obtain 44 <br />the appearance of DBE participation. 45 <br /> 46 <br />Consultant, DBE – An individual, partnership, firm, or corporation who meet the 47 <br />definition of a DBE which has been retained under a contract to provide technical or 48 <br />professional services. 49 <br /> 50 <br />DBE Commitment – The dollar amount and scope of work the Bidder indicates on 51 <br />each line of their DBE Utilization Certification (DOT Form 272-056) for each DBE 52
