2025 FEDERAL OVERLAY, W MUKILTEO BLVD – GLENWOOD AVE TO DOGWOOD DR
PAGE SP33 OF SP123 SPECIAL PROVISIONS
WORK ORDER #3842 April 15, 2025 FEDERAL AID# NHPP-2776(011)
1
The DBE does not perform a CUF if its role is limited to that of an extra participant in 2
a transaction, contract, or project through which the funds are passed in order to 3
obtain the appearance of DBE participation. 4
5
In order for a DBE traffic control company to be considered to be performing a CUF, 6
the DBE must be in control of its work inclusive of supervision. The DBE shall employ 7
a Traffic Control Supervisor who is directly involved in the management and 8
supervision of the traffic control employees and services. 9
10
The following are some of the factors that the Engineer will use in determining 11
whether a DBE trucking company is performing a CUF: 12
13
1. The DBE shall be responsible for the management and supervision of the 14
entire trucking operation for which it is responsible on the contract. The 15
owner demonstrates business related knowledge, shows up on site and is 16
determined to be actively running the business. 17
18
2. The DBE itself shall own and operate at least one fully licensed, insured, 19
and operational truck used on the Contract. The drivers of the trucks owned 20
and leased by the DBE must be exclusively employed by the DBE and 21
reflected on the DBE’s payroll. 22
23
3. Lease agreements for trucks shall indicate that the DBE has exclusive use 24
of and control over the truck(s). This does not preclude the leased truck 25
from working for others provided it is with the consent of the DBE and the 26
lease provides the DBE absolute priority for use of the leased truck. 27
28
4. Leased trucks shall display the name and identification number of the DBE. 29
30
Truck Unit Listing Log 31
In addition to the subcontracting requirements of Section 1-08.1, each DBE trucking 32
firm shall submit supplemental information consisting of a completed primary 33
DBE/FSBE Truck Unit Listing Log (DOT Form 350-077) and all Rental/Lease 34
agreements (if applicable). The supplemental information shall be submitted in an 35
electronic format to the Engineer prior to any trucking services being performed for 36
DBE credit. Incomplete or incorrect supplemental information will be returned for 37
correction. The corrected Primary Truck Unit Listing Log and any Updated Primary 38
Truck Unit Listing Logs shall be submitted and accepted by the Engineer no later 39
than ten calendar days of utilizing applicable trucks. Failure to submit or update the 40
DBE Truck Unit Listing Log may result in trucks not being credited as DBE 41
participation. 42
43
Each DBE trucking firm shall complete a daily DBE/FSBE Truck Unit Listing Log 44
(DOT Form 350-077) for each day that the DBE performs trucking services for DBE 45
credit. The Daily Truck Unit Listing Log forms shall be submitted by Friday of the 46
week after the Work was performed by email to the following email addresses. 47
48
*** 49
CJimenez@everettwa.gov 50
NWRegionOEO@wsdot.wa.gov 51
*** 52
