2025 FEDERAL OVERLAY, W MUKILTEO BLVD – GLENWOOD AVE TO DOGWOOD DR <br /> PAGE SP36 OF SP123 SPECIAL PROVISIONS <br />WORK ORDER #3842 April 15, 2025 FEDERAL AID# NHPP-2776(011) <br />The DBE may lease additional trucks from another DBE firm. The DBE who leases 1 <br />additional trucks from another DBE firm receives credit for the value of the 2 <br />transportation services the lessee DBE provides on the Contract. 3 <br /> 4 <br />The trucking Work subcontracted to any non-DBE trucking firm will not receive credit 5 <br />for Work done on the project. 6 <br /> 7 <br />The DBE may lease trucks from a truck leasing company (recognized truck rental 8 <br />center) but can only receive credit towards DBE participation if the DBE uses its own 9 <br />employees as drivers. 10 <br /> 11 <br />DBE Supplier 12 <br />The credit of a DBE Supplier is decided on a contract-by-contract basis based on 13 <br />what the role the proposed DBE Supplier will be performing. OECR will make 14 <br />determinations on whether a Supplier qualifies as a Regular Dealer, Distributor, or 15 <br />Transaction Facilitator based on their role for the Contract. 16 <br /> 17 <br />Manufacturer - One hundred percent (100%) of the cost of the manufactured 18 <br />product obtained from a DBE manufacturer may count towards the DBE COA 19 <br />Goal. 20 <br /> 21 <br />Regular Dealer - Sixty percent (60%) of the cost of materials or supplies 22 <br />purchased from a DBE Regular Dealer may be credited toward the DBE Goal. 23 <br />Distributor – Forty percent (40%) of the cost of materials or supplies purchased 24 <br />from a DBE Distributor may be credited toward the DBE Goal. 25 <br /> 26 <br />Transaction Facilitator - only the fees or commissions charged for assistance 27 <br />in the procurement of the materials and supplies, or fees or transportation 28 <br />charges for the delivery of materials or supplies required on the job site, may 29 <br />toward the DBE COA Goal provided the fees are not excessive as compared 30 <br />with fees customarily allowed for similar services. The reasonable fee shall not 31 <br />exceed 5 percent of the total cost of the goods or services. Documentation will 32 <br />be required to support the fee/commission charged by the DBE. The cost of the 33 <br />materials and supplies themselves cannot be counted toward the DBE Goal. 34 <br /> 35 <br />Changes in COA Work Committed to DBE 36 <br />The Contractor shall utilize the COA DBEs to perform the work and supply the materials 37 <br />for which each is committed unless prior written approval by the Engineer has been 38 <br />received by the Contractor. The Contractor shall not be entitled to any payment for work 39 <br />or material completed by the Contractor or subcontractors that was committed to be 40 <br />completed by the COA DBEs in the DBE Utilization Certification form. 41 <br /> 42 <br />Changes 43 <br />In the event a change results in a reduction to Work committed to a COA DBE, the 44 <br />Contractor shall substitute other remaining Work to that COA DBE if possible, to 45 <br />avoid a change to the total dollar amount to be applied towards the goal committed 46 <br />to that COA DBE. If there is a reduction to the total dollar amount to be applied 47 <br />towards the goal for a COA DBE Commitment, regardless of the reason, it shall be 48 <br />viewed as DBE termination, and subject to the termination procedures below. A 49 <br />notification to the DBE shall occur as soon as possible but no later than two weeks 50 <br />after the Contractor is aware of the upcoming change. 51 <br /> 52
