Thank you <br />for your application. I am a planner with the City reviewing your proposal against the Unified <br />Development Code (Title 19) to ensure land use and zoning compliance. Please see below for <br />additional information needed and or corrections required before Planning can approve your <br />proposal. <br />The subject property contains critical areas in the form of a creek and geologically hazardous slopes <br />(unknown if wetlands are also present). Any proposed development or alteration to the subject <br />property must be in conformance with the Critical Area regulations found in EMC 19.37. <br />Based on permit history the subject property was constructed in 1987. Because the date of <br />construction falls before the first Critical Area Ordinance was adopted into City code an exemption <br />to the provisions of EMC 19.37 is available to you. However, this exemption requires that your <br />proposed addition does not extend out into the critical area buffer more than the existing legally <br />constructed structures on site, in this case, the deck (EMC 19.37.050.A.k). <br />Without this exemption the critical area buffer for Phillips Creak continues up the slope well into <br />the front of your property. When the minimum buffer for a stream extends into an area with a slope <br />of greater than twenty-five percent (EMC 19.37.170.13) the buffer shall be increased. In this case the <br />buffer shall be twenty-five feet beyond the point where the slope becomes twenty-five percent or <br />less. Then to maintain the integrity of the buffer a building setback requirement is applied from the <br />edge of buffer for ten feet (EMC 19.37.220.B). This would prohibit development on this property <br />which is why we must utilize an exemption in code to permit your proposal. <br />Additionally, the critical area regulations require assessments for properties containing or adjacent <br />to critical areas. A geological report is required to be submitted and reviewed along with your <br />construction drawings (EMC 19.37.070). If the project is feasible the construction of the addition <br />must be built per any geotechnical recommendations found in the report. <br />In addition to submitting a geo report please update the site plan showing where the slope is <br />greater than 25% and show Phillips Creek. <br />Please see the attached document for more code details. <br />
