Consent Decree Exhibit C <br />1.0 Introduction <br />1.1 CLEANUP ACTION PLAN <br />1.1.1 Purpose <br />This document presents the Cleanup Action Plan (CAP) for the Everett Landfill/Tire Fire Site <br />(Site) in Everett, Washington. This document is required by the site cleanup process <br />established by the Washington State Department of Ecology (Ecology) under Chapter 173-340 <br />WAC, "Model Toxics Control Act — Cleanup Regulation" and meets requirements specified in <br />WAC 173-340-360(10), Draft Cleanup Action Plan. <br />The purpose of the CAP is to: <br />• Summarize the status of the Site following the interim and independent cleanup <br />actions. <br />• Describe the selected cleanup actions and compliance monitoring requirements for <br />existing and future conditions. <br />• Provide a document through which public comment may be solicited regarding the <br />cleanup actions. <br />The CAP is one in a series of documents used by Ecology b monitor the progress of site <br />investigation and cleanup. A summary of site investigations and the Site's regulatory history is <br />provided in Section 2.4 and Table 2-1. <br />1.1.2 Applicability <br />This Cleanup Action Plan is applicable only to the Everett Landfill/Tire Fire Site. The cleanup <br />actions have been developed as an overall remediation process conducted with Ecology <br />oversight. <br />1.1.3 Scope <br />The City of Everett (City) and Ecology have been working together for approximately 14 years to <br />evaluate and control potential environmental risks from the closed Everett Landfill/Tire Fire Site. <br />Following two interim actions conducted under Enforcement Orders to regrade and cap the Site <br />and construct a leachate collection system (see Section 2.4.1), the City and Ecology entered <br />into negotiation of a formal CAP and Consent Decree (CD) to finalize administrative <br />requirements for cleanup. In early 1999, Ecology prepared a Draft CAP addressing landfill <br />cleanup requirements. This Draft CAP assumed the Site would remain as a closed landfill, <br />without substantial future redevelopment. This assumption did not reflect the City's current <br />zoning and growth management plans for the Site. <br />Between August 1994 and July 1997, the City revised its Comprehensive Plan in accordance <br />with Growth Management Act requirements. These Comprehensive Plan revisions were <br />supported by an Environmental Impact Statement with substantial public involvement.
