�I <br />U <br />Consent Decree Exhibit C <br />1 <br />1 <br />1 <br />1 <br />1 <br />* Define and implement institutional controls <br />* Maintain integrity of cleanup actions already in place <br />• Existing uses to remain near -term <br />1.2.2 Objectives for Future Conditions <br />The City, as landowner, is seeking to facilitate potential future development of the Everett <br />Landfill/Tire Fire Site consistent with its Comprehensive Plan. This goal is supported by the <br />United States Environmental Protection Agency (USEPA) through that agency's Brownfields <br />Pilot Program, and by Ecology. <br />As noted above, the City does not have a specific development proposal at this time. Instead, <br />the CAP considers potential exposure pathways and remediation alternatives associated with <br />the range of future uses contemplated under the Comprehensive Plan and existing zoning. <br />Under potential future developed conditions, Site use and access characteristics will change. <br />Additionally, development may alter contaminant pathways at the Site. <br />The selected cleanup alternative and environmental requirements for potential future <br />development ensures that all exposure pathways remain controlled during and after <br />development. The following objectives for future conditions ensure that all potential exposure <br />pathways at the Site are permanently controlled based on all applicable regulatory requirements <br />and a use and access scenario consistent with the Comprehensive Plan: <br />• Define additional cleanup actions <br />• Define development restrictions <br />• Define and implement compliance monitoring plans <br />• Prepare contingency plans <br />• Define and implement institutional controls <br />Inclusion of these requirements in the CAP provides the City and subsequent owners or <br />developers of the Site with an approved understanding of site constraints under MTCA <br />necessary to proceed with stimulating redevelopment consistent with the Comprehensive Plan. <br />It also ensures that these MTCA requirements will be implemented and enforced in potential <br />future developments. <br />In order to do this, the CAP specifies remedial measures for the broad range of uses defined in <br />the Comprehensive Plan and Zoning Code, to the extent consistent with Site cleanup <br />objectives. Many of the remedial measures for future conditions will be contingent upon and <br />phased with future development. The CAP recognizes that the City may transfer property <br />ownership to potential purchasers. <br />For future development, this CAP only specifies remedial action requirements. It does not <br />address other environmental or permit requirements that may apply. Any potential future <br />development will undergo SEPA review, and obtain all necessary permits and approvals that <br />may include, but not be limited to, shoreline permits, floodplain development permits, review <br />under the Endangered Species Act, land use and building permits. <br />FINAL - March 2001 1-3 Everett Landfill Tire Fire Site <br />Cleanup Action Plan <br />1 <br />
