1 <br />The City of Everett <br />The Floyd & Snider Team Everett Landfill/Tire Fire Site <br />disposal, and storage of these substances. The regulations found in Chapter 173-303 WAC <br />were amended in November 1996. This amendment declassified the tire ash as a dangerous <br />waste. Therefore, WAC 173-303 is not considered an ARAR for the tire fire ash. <br />PERMIT FOR SOLID WASTE HANDLING FACILITY, RCW 70.95.170, 70.95.180, 70.95.190 <br />Except as provided otherwise in RCW 70.95.305 or 70.95.310, after approval of the <br />comprehensive solid waste plan by the department no solid waste handling facility or facilities <br />shall be maintained, established, or modified until the county, city or other person operating <br />such site has obtained a permit pursuant to RCW 70.95.180 or 70.95.190, described below. <br />RCW 70.95.180 describes the process for obtaining a permit. Applications for permits to <br />operate a new or modified solid waste handling facility shall be on forms prescribed by the <br />department and shall contain a description of the proposed facilities and operations at the site, <br />plans and specifications for any new or additional facilities to be constructed, and such other <br />information as the jurisdictional health department may deem necessary in order to determine <br />whether the site and solid waste disposal facilities located thereon will comply with local and <br />state regulations. <br />RCW 70.95.190 contains guidance for permit renewal. Every permit for an existing solid waste <br />handling facility issued pursuant to RCW 70.95.180 shall be renewed at least every five years <br />on a date established by the jurisdictional health department having jurisdiction of the site and <br />as specified in the permit. Prior to renewing a permit, the health department shall conduct a <br />review as it deems necessary to assure that the solid waste handling facility or facilities located <br />on the site continues to meet minimum functional standards of the department, applicable local <br />regulations, and are not in conflict with the approved solid waste management plan. <br />The Everett Landfill was closed under 173-301 WAC [Regulations Relating to Minimum <br />Functional Standards for Solid Waste Handling] in 1976. The Brownfield Feasibility Study has <br />been prepared to support a Cleanup Action Plan and Consent Decree for both existing and <br />future conditions. Because potential future redevelopment will not include new or modified solid <br />waste disposal facilities, this regulation is not applicable for the Landfill/Tire Fire Site. <br />MINIMUM STANDARDS FOR CONSTRUCTION AND MAINTENANCE OF WELLS, CHAPTER 18.104 RCW; <br />CHAPTER 173-160 WAC <br />The regulations in Chapter 173-160 WAC, which were developed pursuant to Chapter 18.104 <br />RCW, establish minimum standards for construction of all wells in the state, including resource <br />protection wells. Resource protection wells include monitoring wells, observation wells, <br />piezometers, geotechnical test borings, landfill gas probes and spill response wells.
