L� <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />I <br />1 <br />1 <br />1 <br />1 <br />The City of Everett <br />The Floyd & Snider Team Everett Landfill/Tire Fire Site <br />WASHINGTON HYDRAULIC CODE, CHAPTER 75.20 RCW; CHAPTER 220-110 WAC <br />This act regulates construction and other work that would use, divert, obstruct or change the <br />natural flow or bed of any salt or fresh waters to protect fish life from damage in all marine and <br />fresh waters of the state. This code is implemented through a permit called the Hydraulic <br />Project Approval that is obtained from the Washington Department of Fish and Wildlife <br />(WDFW). <br />No proposed cleanup actions would use, divert, obstruct or change the natural flow or bed of the <br />Snohomish River or other waters at the site. <br />HEALTH AND SAFETY FOR HAZARDOUS WASTE OPERATIONS AND EMERGENCY RESPONSE, <br />CHAPTER 296-62 WAC; AND H EALTH AND SAFETY, 29 CAR 1901.120 <br />The Health and Safety for Hazardous Waste Operations and Emergency Response regulate <br />health and safety operations for hazardous waste sites. The Health Safety regulations describe <br />federal requirements for health and safety training for workers at hazardous waste sites. <br />OCCUPATIONAL SAFETY AND HEALTH ACT (OSHA), 29 U.S.C. 653, 655, 657; OCCUPATIONAL <br />SAFETY AND HEALTH STANDARDS, 29 CFR 1910 <br />The Occupational Safety and Health Act of 1970, and amendments thereto, outline the federal <br />requirements for worker health and safety. Employers must annually report on the safety of <br />their operations. Remediation activities at the site, including remediation phased to coincide <br />with future development, will involve activities common to civil construction that have the <br />potential to expose workers to buried refuse. Employee health and safety regulations for <br />construction activities and general construction standards as well as regulations for fire <br />protection, materials handling, hazardous materials, personal protective equipment, and general <br />environmental controls are included in 29 CFR 1926. Hazardous waste site work requires <br />employees to be trained prior to participation in site activities, medical monitoring, monitoring to <br />protect employees from excessive exposure to hazardous substances and decontamination of <br />personnel and equipment. <br />WASHINGTON INDUSTRIAL SAFETY AND HEALTH ACT (WISHA), RCW 49.17; WASHINGTON <br />INDUSTRIAL SAFETY AND HEALTH REGULATIONS, CHAPTER 296-62 WAC, CHAPTER 296-155 WAC <br />The Washington Industrial Safety and Health Act authorizes adoption of rules and regulations <br />which: <br />• Provide for the preparation, adoption, amendment, or repeal of rules and regulations <br />that establish safety and health standards that govern the conditions of employment <br />in all work places; <br />• Provide for the adoption of occupational health and safety standards that are at least <br />as effective as those adopted by the Federal OSHA; <br />Page 9 of 10 Attachment CAP-1 <br />
