CONSENT DECREE EXHIBIT D <br />EVERETT LANDFILL/TIRE FIRE SITE <br />Gas Exposure Pathway <br />F-1. <br />All future Site development will include design, design review, construction, operation <br />and maintenance of phased active landfill gas control systems for buildings, pavement <br />and open space per the CAP as development occurs. This includes sealing, booting and <br />finishing requirements for light fixtures, fence and similar features. <br />posts, pilings <br />F-2. <br />All future Site development that includes pavement areas will prepare and comply with a <br />construction quality assurance plan which details pavement permeability testing. This <br />plan will be sibmitted to an approved by Ecology. <br />F-3. <br />All future Site development will include installation of continuous monitors and <br />controllers in all ground floor rooms of any new building or temporary enclosure. <br />Monitors will be operated in accordance with the CMCP. Their calibration and <br />maintenance shall be in accordance with manufacturer's recommendations. <br />F-4. <br />All future Site development will perform Confirmational Monitoring of the landfill gas <br />discharge location(s) in accordance with the CMCP (attachment to Exhibit Q. <br />F-5. <br />Inspections and monitoring of all future Site development areas will be conducted in <br />accordance with the CMCP (attachment to Exhibit Q. <br />F-6. <br />All future Site development will permit and comply with permit requirements for <br />regulated landfill gas discharges. <br />Groundwater Exposure Pathwav <br />F-7. <br />The City shall initiate groundwater compliance monitoring in accordance with the CMCP <br />prior to any new installation of pile foundations. <br />F-8. <br />The City shall perform a shallow aquifer quality characterization sampling round and <br />associated evaluation to establish potential zones for pile -type restrictions. <br />F-9. <br />The City shall incorporate any pile -type restrictions into deed restrictions if necessary. <br />F-10. <br />All future Site development requires design, design review, construction, operation and <br />maintenance of landfill developed area covers per the CAP (hydraulic barrier beneath <br />landscaping, pavements, building slabs). <br />F-11. All future Site development will require offsite discharge and restricted infiltration of <br />collected stormwater as described in the CAP, including requiring leak -tight joints for <br />conveyance piping. <br />Direct Contact Exposure Pathway <br />F-12. All future Site development requires maintenance of landfill developed area covers <br />(hydraulic barrier beneath landscaping, pavements, building slabs) and undeveloped area <br />soil cap. <br />FINAL Exhibit D Page 3 of 13 <br />
