CONSENT DECREE EXHIBIT D <br />EVERETT LANDFILL/TIRE FIRE SITE <br />F-13. All future Site development requires backfill meeting WSDOT/APWA Specification 9- <br />03.12(3) or equivalent in utility corridors with geotextile separation, to allow utility <br />maintenance to be conducted without additional health and safety requirements for <br />contaminated material. <br />F-14. The City shall maintain access controls (fencing, locked gates, signage) to prohibit <br />uncontrolled public access to undeveloped areas of the site. <br />F-15. All future Site development requires certification of construction signed by a professional <br />engineer to ensure requirements for construction described in the Cleanup Action Plan <br />are met. <br />F-16. All future Site development requires compliance monitoring in the form of site <br />inspections and reporting. <br />Surface Water Exposure Pathway <br />F-17. The City shall perform compliance monitoring in accordance with the CMCP, including <br />semi-annual sampling of surface water within the site boundary to determine compliance <br />with cleanup standards at the point of compliance. <br />F-18. A SWPPP for developed site conditions shall be prepared and implemented prior to site <br />development activities. <br />Schedule of Work <br />Work to be performed under existing conditions will occur on the following schedule. <br />Field investigation to determine the limits of buried waste: It is the City's intent to <br />initiate this field investigation prior to the effective date of this Decree, pending BNSF <br />access approvals. The draft investigation work plan will be submitted to Ecology and <br />BNSF for review and approval before 12/15/00. The field investigation work will <br />commence within 30 days of Ecology's approval of the work plan, contingent on <br />obtaining access to the investigation area. A Field Investigation Report will be prepared <br />and submitted to Ecology and BNSF within 90 days of completing the field investigation <br />work. <br />Installation of new perimeter gas monitoring network: New perimeter gas monitoring <br />wells will be installed within 120 days after the completed Field Investigation Report <br />receives approval from Ecology and BNSF, contingent on obtaining access to the area. <br />Engineering design report (EDR) for perimeter gas migration control options: A draft <br />EDR will be submitted to Ecology and BNSF for review and approval within 90 days <br />following completion of the Field Investigation Report. <br />Site SWPPP: A draft SWPPP for the existing Site will be prepared and submitted to <br />Ecology within 90 days of the effective date of this Decree. <br />1 <br />1 <br />1 <br />1 <br />1 <br />LJ <br />1 <br />1 <br />1 <br />1 <br />I <br />1 <br />1 <br />1 <br />1 <br />1 <br />FINAL Exhibit D Page 4 of 13 <br />
