CONSENT DECREE EXHIBIT D <br />EVERETT LANDFILL/TIRE FIRE SITE <br />At the time that the City is made aware of scheduled development submittals, the City shall have <br />a pre -application meeting with Ecology. At this meeting the City and Ecology will agree to the <br />submittal and review schedule. <br />The City shall review all development submittals to ensure compliance with Cleanup Action <br />Plan requirements. For submittal review, the City shall complete the attached checklist to record <br />comments regarding Cleanup Action Plan compliance and flag relevant sections of development <br />documents. Following City review, the City shall deliver both the development submittal and <br />attached checklist to Ecology for Ecology review. <br />During site construction, in accordance with construction requirements detailed in the CAP, the <br />City shall review the progress and completeness of construction via checklists, site visits and <br />periodic updates. The City will inform Ecology of construction schedules, and allow the <br />opportunity for Ecology to observe construction activities as desired. <br />The City shall require developers to submit as -built documentation of environmental <br />construction elements to the City, which can additionally be provided to Ecology upon request. <br />The City shall provide occupancy permits for development only after confirmation has been <br />made that environmental requirements are fully met. Notification of compliance and occupancy <br />shall be provided to Ecology. <br />FINAL Exhibit D Page 6 of 13 <br />
