In the event that a waiver or modificatfon of zoning regulatfons in a given situatfon is 1 <br />required by a law other than the FHA, such waiver or modificatfon shall be requested and 2 <br />reviewed using the procedures established in this sectfon. 3 <br />B. Applicatfon Requirements. 4 <br />1. Requests for reasonable accommodatfon shall be submitted to the planning director, along 5 <br />with any applicatfons fees required pursuant to Chapter 16.72 EMC, if any. 6 <br />2. The request shall include informatfon as determined necessary by planning director to make 7 <br />a determinatfon whether reasonable accommodatfon should be approved. Unless waived by the 8 <br />planning director, the applicant shall submit the following informatfon: 9 <br />a. Name of property owner(s). 10 <br />b. The specific modificatfon(s) of the Unified Development Code requirements 11 <br />requested in order to allow the reasonable accommodatfon. 12 <br />c. The nature of the disability or disabilitfes of the individual(s) for whom the 13 <br />accommodatfon is requested, and an explanatfon why the specific accommodatfon is 14 <br />necessary based on the disability. 15 <br />d. Such other informatfon as may be determined by the planning director following 16 <br />either a preapplicatfon meetfng or review of a request for reasonable accommodatfon. 17 <br />C. Planning Director Approval. 18 <br />1. The following shall be taken into consideratfon in whether to approve a request for 19 <br />reasonable accommodatfon: 20 <br />a. Whether any adverse impacts would happen if the request for reasonable 21 <br />accommodatfon is approved based on the size of the dwelling and lot, traffic and parking 22 <br />conditfons on the lot and in the surrounding area including streets, antfcipated vehicle 23 <br />usage by residents and visitors, and any other circumstances the planning director 24 <br />determines relevant to determine adverse impacts. 25 <br />b. The applicant’s need for accommodatfon in light of the antfcipated land use impacts. 26 <br />2. If handicap eligibility and need for accommodatfon are demonstrated, the planning director 27 <br />shall approve an accommodatfon, unless the requested accommodatfon would make a dwelling 28 <br />available to an individual whose tenancy would constftute a direct threat to the health or safety 29 <br />of other individuals or whose tenancy would result in substantfal physical damage to the 30 <br />property of others. 31 <br />3. Any decision to grant reasonable accommodatfon applies specifically to the property 32 <br />identffied in the decision, and may not be transferred to any other property. 33 <br />D. Other Provisions. 34 <br />1. Approval of reasonable accommodatfon permits a dwelling to be inhabited only according to 35 <br />the terms and conditfons of the applicant’s proposal and the director’s decision. 36
