If the planning director determines that the accommodatfon has become unreasonable 1 <br />because circumstances have changed or adverse land use impacts have occurred that were not 2 <br />antfcipated, the planning director shall rescind or modify the decision to grant reasonable 3 <br />accommodatfon. 4 <br />3. Eligibility for a reasonable accommodatfon under the Fair Housing Act does not relieve the 5 <br />owner, applicant and residents from the obligatfon to comply with all building, fire, land use and 6 <br />all other standards and regulatfons applicable under local, state and federal laws. 7 <br />4. Any decision on a request for accommodatfon is unique to the specific circumstances related to the 8 <br />individual request and locatfon. A decision issued for a specific property shall not establish a precedent 9 <br />that would be applicable to any other request for accommodatfon. 10 <br />19.08.140 BED AND BREAKFAST HOUSE. 11 <br />Repealed by Ord. 3896-22. 12 <br />19.08.150 SHORT TERM RENTALS. 13 <br />Short-term rentals shall comply with the following provisions: 14 <br />A. License Required. A city business license is required to operate a short-term rental. No more than 15 <br />two short-term rental sites may be operated by any individual, marital group, a group of people, or a 16 <br />corporate entfty such as an LLC, within the city. 17 <br />B. Locatfon. A short-term rental use may be located in a dwelling unit or an accessory dwelling unit. See 18 <br />EMC 19.08.100 for applicable accessory dwelling unit requirements, including owner occupancy if 19 <br />applicable. 20 <br />C. Number of Guests. The total number of guests occupying a dwelling unit may not exceed eight on a 21 <br />site, including any site with an accessory dwelling unit. 22 <br />D. Signs. No signs identffying the use as a short-term rental are permitted. 23 <br />19.08.200 HOMELESS SHELTER AND HOUSING 24 <br />A. Applicability. 25 <br />1. This sectfon applies to the following uses: 26 <br />a. Emergency housing. 27 <br />b. Indoor emergency shelter. 28 <br />c. Outdoor emergency shelter. 29 <br />2. This sectfon shall not apply to: 30 <br />a. Emergency or disaster situatfons as defined by RCW 38.52.010(9); provided, 31 <br />however, that the inability of a sponsor or managing agency to locate a site shall not be 32 <br />deemed to constftute an emergency or disaster. 33
