The alteratfons do not create a greater nonconformance unless otherwise 1 <br />allowed through modificatfon of standards; and 2 <br />iii. The alteratfons are not as a result in a change of use or occupancy (see 3 <br />subsectfon (B)(2)(c) of this sectfon). 4 <br />c. Interior alteratfons which do not change the exterior appearance of the building 5 <br />and/or site. 6 <br />d. Change of use or occupancy which is either a minor exterior alteratfon or interior 7 <br />alteratfons; provided, however, that if the change in use or occupancy creates additfonal 8 <br />off-street parking or uses outdoor areas to conduct business or store materials, the 9 <br />development shall provide the following: 10 <br />i. The development shall meet the parking requirements of this tftle, Chapter 11 <br />19.34 EMC (Parking, Loading and Access Requirements) and, as required, 12 <br />Chapter 19.35 EMC (Landscaping) and Chapter 19.33 EMC (Streets, Sidewalks 13 <br />and Pedestrian Circulatfon); and 14 <br />ii. Any building alteratfon includes weather protectfon as required by this 15 <br />chapter. 16 <br />2. Conflicts. In the event of a conflict between these requirements and the standards of other 17 <br />sectfons of the Unified Development Code, these requirements shall control; provided, however, 18 <br />the requirements established as part of the creatfon of any historic overlay zone shall take 19 <br />precedence over any conflictfng requirements in this chapter. 20 <br />3. Mixed UseDevelopments. When multffamily development is to be part of a mixed-use 21 <br />commercial development, the requirements contained herein shall apply to the multffamily 22 <br />development but may be modified by the planning director as needed to provide for the For 23 <br />mixed developments refer to the following sectfons as applicable, provided that the Planning 24 <br />Director is authorized to interpret applicability to provide for reasonable accommodatfon of 25 <br />mixed-use and commercial development encouraged by the comprehensive plan.: 26 <br />a. For development standards for detached one- and two-unit dwellings and any number 27 <br />of townhouses up to three stories in height, along with their accessory structures, refer 28 <br />to Chapter 19.08 EMC; and 29 <br />b. For development standards for residentfal development other than detached one- 30 <br />and two-family dwellings and townhouses up to three stories in height, along with their 31 <br />accessory structures, refer to this Chapter 19.09 EMC; and 32 <br />c. For development standards for nonresidentfal development, refer to EMC 19.09.200 33 <br />through EMC 19.09.260 34 <br />4. Future Phases. When multffamily residentfal development is proposed to be added as a later 35 <br />phase to an existfng multffamily development which does not meet the requirements contained 36 <br />herein, the requirements contained herein shall apply, but may be modified by the planning 37
