EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 126 <br />(2) Rear setback areas which are contfguous with other on-site common open 1 <br />space areas and which are not part of a street side setback area on corner lots. 2 <br />9. Plans for amenity space, including outdoor and common areas, shall be submitted for review 3 <br />and approval of the planning director prior to issuance of building permits. 4 <br />10. A payment in lieu of providing the common or private open space may be approved by the 5 <br />planning director. 6 <br />a. The fee may be in lieu of up to fifty percent of the required on-site common or 7 <br />private open space; provided, that the fee may be in lieu of up to one hundred percent 8 <br />of the required on-site common or private open space where the subject property is 9 <br />within a half mile of an existfng or planned public park or trail consistent with the Everett 10 <br />parks, recreatfon, and open space plan in effect at the tfme of applicatfon. 11 <br />b. The fee per square foot of common or private open space not provided shall be 12 <br />equal to the average capital cost per square foot of neighborhood parks as identffied in 13 <br />the capital facilitfes element of the comprehensive plan. 14 <br />c. The payment shall be held in a reserve account by the city and may only be 15 <br />expended to fund a capital improvement for parks and recreatfon facility identffied in 16 <br />the Everett parks, recreatfon, and open space plan in effect at the tfme of applicatfon. 17 <br />d. The payment shall be expended in all cases within five years of collectfon; provided, 18 <br />that any payment not so expended shall be refunded with interest to be calculated from 19 <br />the original date the deposit was received by the city and at the same rate applied to tax 20 <br />refunds pursuant to RCW 84.69.100; however, if the payment is not expended within 21 <br />five years due to delay attributable to the developer, the payment shall be refunded 22 <br />without interest. 23 <br />Table 9-2: Multifamily Open Amenity Space Calculation (Example) 24 <br />Large Project (50+ Units) <br />Unit Size # of Units Area per Unit (sq. ft.)
