Private open space shall be a minimum of six four feet in any directfon, no less than 2 <br />thirty-sixtwo square feet in area. 3 <br />b. Common open space shall be include area a minimum of twenty feet in any 4 <br />directfon, and total no less than four hundred square feet in area. The cCommon open 5 <br />space must be located to provide convenient and accessible access from the residentfal 6 <br />units. 7 <br />5. Top floors and/or roof top decks may be used for up to one hundred percent of required 8 <br />outdoor area provided: 9 <br />a. Amenitfes such as seatfng areas, landscaping, lightfng, weather protectfon and other 10 <br />features that encourage use year-round, as approved by the planning director, are 11 <br />incorporated. 12 <br />b. The space must have hard durable surfacing for all trafficked areas. 13 <br />6. Off-street parking and loading areas shall not be considered as outdoor or common areas, 14 <br />nor as other amenity space as required by this sectfon. 15 <br />7. Expansion of Residentfal Development. Where an increase in the number of dwelling units 16 <br />for a residentfal development is proposed, common area shall be provided in accordance with 17 <br />the requirements of this chapter, minus the amount of common area by which the previous 18 <br />residentfal development was deficient. 19 <br />8. When setback areas can be included in calculatfons: 20 <br />a. Private open space located at ground level may extend into the required setback 21 <br />areas, subject to minimum size standards in subsectfon (B)(4) of this sectfon, but when 22 <br />located within a required street setback, the outdoor area must either be at least two 23 <br />feet above the grade of the closest adjoining sidewalk or separated from the street lot 24 <br />line by a minimum three-foot setback landscaped to create privacy. 25 <br />Figure 9-7: Example of Private Open Space in Front Setback 26 <br /> 27 <br />b. Common open space may include: 28 <br />(1) Interior side setback areas which are contfguous with other on-site common 29 <br />open space areas; 30
