Use of a landscaping treatment as part of the building’s design, such as 1 <br />planters or wall trellises. 2 <br />f. Decorative or special railings, grill work, or landscape guards. 3 <br />g. Landscaped trellises, canopies, or weather protection. 4 <br />h. Sculptural or hand-crafted signs. 5 <br />i. Special building elements, such as pilasters, entablatures, wainscots, 6 <br />canopies, or marquees that exhibit nonstandard designs. 7 <br />13. The maximum number of retail marijuana stores allowed in the city of Everett shall 8 <br />not exceed eight. Any retail marijuana store hereafter established shall be certifled as a 9 <br />medical marijuana provider by the Washington State Liquor and Cannabis Board. 10 <br />D. Measurements. Distances provided under this section shall be measured as the shortest 11 <br />distance between the perimeters of the parcels at issue. 12 <br />E. Compliance. Marijuana producers, marijuana processors, and marijuana retailers are 13 <br />required to acquire all necessary business licenses and are required to comply with municipal 14 <br />tax regulations and all other applicable city ordinances and regulations. 15 <br />F. Establishment. For purposes of the two-thousand-flve-hundred-foot setback between 16 <br />marijuana retailers, marijuana retailers shall be considered to be legally established in the 17 <br />order in which they are issued a city of Everett business license. The city will not accept a 18 <br />business license application for a recreational marijuana business prior to the applicant 19 <br />providing the city a copy of a letter from the Washington State Liquor and Cannabis Board 20 <br />indicating that the applicant has been approved for a recreational marijuana license. The city 21 <br />will process business license applications for recreational marijuana businesses in the order in 22 <br />which they are accepted. 23 <br />G. Enforcement. Any violation of this section is subject to enforcement under the provisions of 24 <br />Chapter 1.20 EMC or through action of the city attorney seeking injunctive or other civil relief in 25 <br />any court of competent jurisdiction. The violator will be responsible for costs, including 26 <br />reasonable attorney fees. 27 <br />19.13.170, MINI-CASINOS 28 <br />The following regulations shall apply to mini-casinos: 29 <br />A. The space devoted to gambling and gaming activity and support services (i.e., security) shall 30 <br />not be more than eight thousand square feet. Other incidental uses such as restaurant or 31 <br />nightclub uses shall not be restricted by the eight thousand square feet limitation if no 32 <br />gambling or gaming activity occurs within such space. 33 <br />B.
