The distance provided for line of sight shall be measured by following a straight line from the 3 <br />nearest point of the property parcel upon which the secure community transitfon facility is to be 4 <br />located, to the nearest point of the parcel of property or land use district boundary line from 5 <br />which the proposed land use is to be separated. 6 <br />3. In order to assist in providing equitable distributfon, there shall be a separatfon of one mile 7 <br />between an SCTF and any existfng SCTF, jail, correctfonal facility, mental health facility, work 8 <br />release, pre-release or similar facility. (A “similar facility” includes, but is not limited to, Madison 9 <br />House, Everett Gospel Mission Men Shelter, Everett Gospel Mission Women and Children Shelter, 10 <br />Green House, Evergreen Manor and establishments providing similar services.) 11 <br />D. Review Process III (Special Property Use/Conditfonal Use Permit). A conditfonal use permit Review 12 <br />Process III applicatfon for SCTF shall comply with all the permitting and procedural requirements 13 <br />pertaining to a conditfonal use permit Review Process III including those found under EMC Title 15. 14 <br />E. Existfng SCTFs. In the event a SCTF is legally sited in accordance with the provisions of this tftle, this 15 <br />does not preclude any subsequent sitfng of any risk potentfal actfvity described in subsectfon (C)(1) of 16 <br />this sectfon within the line of sight. 17 <br />F. When evaluatfng an applicatfon for a SCTF consideratfon shall also be given to those sitfng provisions 18 <br />provided in RCW 71.09.250(8). 19 <br />CHAPTER 19.17 – AIRPORT/PORT/NAVY COMPATIBILITY 20 <br />19.17.005 USER GUIDE. 21 <br />This chapter establishes a mechanism for review of certain project proposals and permits within areas 22 <br />close in proximity to Paine Field, the Port of Everett, and/or Naval Statfon Everett. These areas are may 23 <br />be characterized by heavy industrial use and higher levels of noise, light, and glare than otherwise found 24 <br />in other areas of the city. 25 <br />19.17.010 PURPOSE. 26 <br />The purpose of this chapter is to provide for uses allowed in the underlying zones while protectfng Paine 27 <br />Field, the Port of Everett, and/or Naval Statfon Everett from nearby incompatfble land uses and 28 <br />development by: 29 <br />A. Identffying areas where incompatfble uses should be discouraged; 30 <br />B. Notffying property owners if their property is of property located adjacent to Paine Field, the Port of 31 <br />Everett marine terminal, or Naval Statfon Everett, within the Paine Field airport influence area overlay 32 <br />that they may experience impacts from operatfons and may be subject to certain limitatfons; 33 <br />C. Notffying applicants for certain development actfvitfes or uses within the port compatfbility area that 34 <br />they may experience impacts from operatfons and may be subject to certain limitatfons. 35
