Uses and Development Approvals Within the Port Compatfbility Area (PCA). All propertfes located 3 <br />within the PCA Port Compatfbility Area shall be permitted to have the same uses as permitted in the 4 <br />underlying zoning district subject to the requirements of the underlying use zone and the requirements 5 <br />of this sectfon. 6 <br />1. The city shall provide a written notfce of permit applicatfons to the managers of the port for 7 <br />new developmental actfvitfes with more than development applicatfons for new constructfon or 8 <br />building expansion resultfng in of ten thousand square feet of building gross floor area within 9 <br />the PCA, and shall allow the manager(s) to submit comments to the department regarding the 10 <br />proposal, including those related to potentfal adverse impacts on port operatfons, in additfon to 11 <br />any notfce requirements for the proposed use or underlying use zone for Review Process II, III, or 12 <br />V applicatfon. A preapplicatfon meetfng under EMC Title 15 may be required unless waived by 13 <br />the city. 14 <br />2. The city shall consider comments provided by the Port of Everett, and where necessary, 15 <br />apply such conditfons of approval to mitfgate potentfal impacts to port operatfons or to identffy 16 <br />measures the applicant may employ to mitfgate potentfal or perceived impacts to their proposed 17 <br />project related to existfng or future port operatfons. 18 <br />B. Notfce and Disclosure Within Port Compatfbility Area. This subsectfon establishes notfficatfon and 19 <br />disclosure requirements for any development applicatfons development actfvitfes or uses within a port 20 <br />compatfbility area (PCA) subject to the requirements of identffied in subsectfon EMC 19.17.110(A)(1) this 21 <br />sectfon applicatfon for more than ten thousand square feet of building gross floor area within the PCA. 22 <br />1. The city shall provide written notfce to applicants that their project is within the PCA and 23 <br />written disclosure of potentfal impacts to the property related to port operatfons. The text of the 24 <br />written notfce and disclosure shall be maintained by the Planning Director with input from the 25 <br />managers of the port. 26 <br /> That notfce shall include the following language: 27 <br />Your real property is located within the Port Compatfbility Area (PCA). Occupants of 28 <br />propertfes within the PCA may be subject to inconveniences or discomforts arising from 29 <br />maritfme actfvitfes, including but not limited to noise, odors, glare, fumes, dust, 30 <br />constructfon actfvity, smoke, traffic, hours of operatfon, low overhead flights and other 31 <br />maritfme actfvitfes. Everett Municipal Code (EMC) 19.17. requires that you receive this 32 <br />disclosure notfce in connectfon with permits you are or may be seeking. Provisions of 33 <br />EMC 20.08 provide that noise exemptfons apply to “created by watercraft ... in 34 <br />operatfon”, and “operatfon of equipment or facilitfes of surface carriers engaged in 35 <br />commerce by railroad”. The City of Everett has adopted PCA regulatfons in Chapter 19.17 36 <br />EMC which may affect you and your land. 37 <br />2. Applicants for development identffied in subsectfon EMC 19.17.110(A)(1) within the PCA are 38 <br />encouraged, but not required, to work cooperatfvely with the Port of Everett in the design of 39
