Requirements for Height Incentive Program. 1 <br />1. General. In order to receive the additfonal heights shown in Table 22-5 above, development 2 <br />must meet the following requirements for the applicable incentfve. 3 <br />2. Affordable Housing. 4 <br />a. “Affordable housing” means residentfal housing for low- and moderate-income 5 <br />households as defined in Chapter 3.78 EMC regarding multffamily housing property tax 6 <br />exemptfon. 7 <br />b. Affordable housing can be provided on site or off site, or a payment in lieu of 8 <br />providing affordable housing can meet this requirement. 9 <br />c. Rent/Sale and Income Restricted. Any development which receives a height bonus by 10 <br />providing affordable housing shall be required to record a deed restrictfon which will 11 <br />restrict the rent or sale of the housing units to those households whose income qualifies 12 <br />for this program. The length of the deed restrictfon shall be no less than fifty years. 13 <br />d. Fee-in-Lieu-of Program. A fee in lieu of, at a reduced ratfo of two to one, may be 14 <br />approved by the planning director. See subsectfon (D)(9) of this sectfon. 15 <br />3. Historic Building Preservation. 16 <br />a. A development project may provide for the preservatfon of historic resources 17 <br />through the city’s transfer of development rights program. 18 <br />b. The development rights must be obtained from a building on the city of Everett’s 19 <br />register of historic places. 20 <br />c. Any improvements to buildings from which development rights are transferred will 21 <br />be required to meet city requirements for historic buildings as set forth in a 22 <br />development agreement approved by the planning director. 23 <br />4.
