Additfonal building height is allowed for buildings certffied by the U.S. Green Building 1 <br />Council, or equivalent standards. 2 <br />b. Any use of equivalent green building standards must be approved by the planning 3 <br />director. 4 <br />c. If certfficatfon has not been achieved at the tfme the first certfficate of occupancy is 5 <br />issued for the building, the developer shall post a performance bond in a form 6 <br />acceptable to the city. The performance bond shall be based on the value of land per 7 <br />square foot of building in the area of the city in which the proposed development is 8 <br />located. The developer will forfeit the performance bond if green building certfficatfon is 9 <br />not achieved within one year of the city’s issuance of the certfficate of occupancy. The 10 <br />city reserves the right to use the funds for any purpose, including but not limited to 11 <br />green building improvements to publicly owned buildings. 12 <br />5. Public Parking. 13 <br />a. Where Available. This height incentfve is only available in Metro Everett. 14 <br />b. Building Use and Public Parking. 15 <br />(1) Residential Parking Spaces. Parking spaces that serve residences during the 16 <br />evening must be made available to the public between seven-thirty a.m. and 17 <br />five-thirty p.m. 18 <br />(2) Nonresidential Parking Spaces. Parking spaces that are dedicated to 19 <br />nonresidentfal use during the day shall be made available to the public between 20 <br />the hours of five-thirty p.m. and one a.m. 21 <br />c. Fees. Reasonable, market-rate fees may be charged for public parking. A fee schedule 22 <br />shall be submitted to the planning director annually for review and approval. 23 <br />d. Term. The property owner will be required to record deed restrictfons that show that 24 <br />the city will retain a permanent interest in the public parking as long as the building is 25 <br />occupied. The form and conditfons of the deed restrictfons must be approved by the city 26 <br />and will be required before a final certfficate of occupancy. 27 <br />6. Public Art. 28 <br />a. To receive an incentfve height bonus for public art, a developer must contribute fees 29 <br />set forth in subsectfon (D)(9) of this sectfon to the city of Everett municipal arts fund. In 30 <br />lieu of providing the financial contributfon to the fund, the city’s cultural arts 31 <br />commission may approve public art to be completed by the developer; provided, that 32 <br />the value of that art equals the fees set forth in subsectfon (D)(9) of this sectfon. 33 <br />b. All public art shall include a maintenance plan to ensure the public art is properly 34 <br />funded and maintained. 35 <br />7. Agricultural Land Preservation. 36
