The in-lieu-of fee would be one hundred twelve 1 <br />thousand five hundred dollars based on 2020 rates. (2 x 7,500 x $7.50 = 2 <br />$112,500.) In this example, the developer would have four additfonal floors, or 3 <br />thirty thousand square feet of gross floor area, in exchange for an affordable 4 <br />housing fee of one hundred twelve thousand five hundred dollars. 5 <br />Fee Calculatfon Example No. 2: A developer wishes to build one additfonal floor 6 <br />and provide to the city’s public art fund. The gross floor area of that incentfve 7 <br />floor is seven thousand five hundred square feet. The in-lieu-of fee would be 8 <br />fifty-six thousand two hundred fifty dollars based on 2020 rates. (7,500 x $7.50 = 9 <br />$56,250.) 10 <br />c. City Funds. Any fees accepted by the city shall be deposited into city funds to be used for the purpose 11 <br />for which they were deposited. The city will annually account for the deposit and expenditure of the 12 <br />funds provided in lieu of the developer providing the required benefit. 13 <br />19.22.090, OTHER ACCESSORY STRUCTURES AND APPURTENANCE HEIGHT LIMITS. 14 <br />A. Antennas. 15 <br />1. Except for amateur radio towers and antennas as set forth in subsectfon (A)(2) of this 16 <br />sectfon, the height of any antenna shall not exceed five feet above the maximum permitted 17 <br />building height above the base elevatfon of the principal building and shall not exceed the 18 <br />horizontal distance between the base of the antenna and the nearest property line. 19 <br />2. Amateur radio towers and antennas for use by a noncommercial, licensed amateur operator 20 <br />shall be allowed if they: 21 <br />a. Do not exceed the height of sixty-five feet above the base elevatfon of the principal 22 <br />building; 23 <br />b. Are located and constructed in a manner that will prevent it from falling onto 24 <br />adjoining propertfes; 25 <br />c. Do not interfere with nearby utflity lines, etc.; 26 <br />d. Are not located within any required setback area. 27 <br />3. An amateur radio tower or antenna may exceed sixty-five feet above the base elevatfon of 28 <br />the principal building if approved by the planning director using Review Process II described in 29 <br />EMC Title 15, Local Project Review Procedures. In order to approve an antenna or tower height 30 <br />which exceeds sixty-five feet above the base elevatfon of the principal building, the planning 31 <br />director shall approve the minimum height necessary to reasonably allow for transmission and 32 <br />receptfon of radio signals, and the antenna or tower shall: 33 <br />a. Be located and constructed in a manner that will prevent it from falling onto adjacent 34 <br />propertfes; 35 <br />b. Not interfere with nearby utflity lines; 36 <br />c. Not be located within any required setback area. 37
